JEW HIGHWAY PPROBE STARTED (Continued From Page 1) last summer. Others facing trial under the same Indictment are John D. Williams, director of the commission and George Bartley, former superintendent of equipment. Moses and Victor Goldberg, local junk dealers, and C. William Whaley, were indicted March 4, at the sarne time on charges of grand larceny in connection with the alleged theft of war materials which had been turned over to the commission. During the last few weeks William P. Cosgrove, another field examiner, has been at work in the office of the way commission’s revolving fund. In connection with the audit at the highway garage,, one of the principal matters which is to receive at-, tention is the question of the legality of Crawford's present employment. Some State- officials say the law creating the highway board did not contemplate full-time employment of a commissioner. The only provision of the law, they say, is for a $lO per diem allowance for commissioners when they are meeting in full board. Crawford is drawing $lO allay for every week day, and in addition, is collecting hotel expenses. Commission employes who reside at the place of their assignment are not allowed to collect expenses. Per Diem Probed Another matter which has been noted is the increasing number of days each month on w r hich certain commissioners charge per diem allowance. Although the commission meets on an average of about two days a month, one commissioner, it is said, has been charging from twelve to fifteen days a month. He recently made a per diem charge foj a Sunday and the pay warrant for that day was withheld by the State auditor, it was reported. The field examiners also will investigate the report that some attaches of the commission have sent their privately-owned automobiles to the garage and had them equipped with tires and so far have made no settlement. Automobile accessories, including motors, have been disposed of in the same way, it is charged. Locomotives in Pasture Two narrow-gauge locomotives, which cost the Government approximately $15,000, and which are standing in a woods-pasture near Putnam ville, have never been reclaimed by the commission, it is said. It is alleged they were “farmed out” by the commission to an independent road contractor and dumped in the woods, without ever being salvaged by the commission. Although the engines were new when received by the commission, they are useless ifow, a former employe of the commission declared after viewing them. In the meantime a frenzied effort Is being made by friends of the commission to have the indictments against Williams and Crawford quashed. Considerable pressure has been brought to bear against Prosecutor William H. Remy. Remy has announced the two will not be brought to trial this year, because of a crowded court docket. If the indictments remain dormant until Jan. 1, 1927, they will become invalid through the statute of limitations. Gilliom Hires Lesh Attorney General Arthur L. Gilliom said that he will not be able to participate in the prosecution, since the field examiners’ report on which the indictments were based has been impounded by court order. He announced, however, that he has retained U. S. Lesh, former attorney general, to represent the State in the suit of Otto F. Schlensk&r to recover a $50,000 check he gave the board of accounts. ‘PEEPING TOM’ DRAWS SHOTS Minor Thefts Are Reported to Police. Harry Ogden, 1166 W. Thirty-Sixth St., fired three shots at a colored “peeping tom" peering into the window at the home of Miss Alice Wade, 1818 Central Ave., late Wednesday night.
