APPLE TREES, WHAT ARE THEY, QUESTION State Tax Board Puzzled Over Recent Amendment A Made to Goodrich Tax Law.
What is an apple tree? “Now don’t be silly,” the average man will reply. “Any one can tell you it’s a tree on which apples grow. Hence the name apple tree.” The average man, however, Is not afflicted with officially solving the problem. Just at present the combined wisdom of the State tax board, the State attomev general’s office and about every one else in the Statehouse -is being called on to decide whether an apple tree, also peach and other fruit trees, are real estate or personal property. met the apple growers got busy and amended the Goodrich tax law to exempt ‘growing crops, vegetables or fruit trees which may be found growing thereon (real estate) at the time of such assessment.” Formerly trees were counted as part of the realty. Then township assessors went to work and assessed the apple trees as personal property, disregarding plaints of the apple growers. The State attorney general, who was appealed to, dug out a copy of the more or less obsolete State constitution, aVid verified the assessors’ contentions that everything not real estate is personal property,
s i. : vs ■ }; exempting only for municipal, educational, literary, scientific, religious or charitable purposes.” Now the State tax commissioners are scratching their heads over the row, and have decided to call a meeting in which all hands can argue all they please. Growing wheat and forest trees 'will be two additional topics of discussion at the meeting. Like fruit trees <they l ave heretofore been taxed as part of the real estate. Frank Wallace, State entobologist, who takes keen interest in all affairs of State, has suggested to his harassed official brethren they solve the difficulty by classing fruit trees as literary or religious’ works. “With all the Biblical terms I hear being spilled over this matter I think there is some element of exemption there under the constitutional clause,” he said.
