GRANDAD FINED 50 CENTS FOR WIFE-BEATING Neighbors Unable to Solve} Conundrum Despite Discussion. VIENNA, Nov., 16. —Johann Wacorosky is a real life conundrum which his neighbors have been unable to solve despite much discussion and debate. He is seventy years old, is a greatgrandfather, is the father of a child only five months old, and is still a wife-beater. According to his neighbors, a man who has reached the age of .seventy and has had such ample opportunity to spank three generations of children, should have lost his interest in such pastimes as wife beating. His wife agrees with them, and, although she last aroused his wrath and beating proclivities by coming home drunk late one evening, she carried her bruises and her husband before a local magistrate. Wacrosky was fined the equivalent of fifty cents. DRIVER IS FREED Bv United Brens NOBLESVILLE, Ind., Nov. 16. April 2—Stephenson arrested on affidavits charging assault and bat tery with intent to kill, kidnaping and conspiracy to commit a fel ony. Affidavits sworn to by George Oberholtzer, father of Madge Ober holtzer, 28, of 5802 University Ave. Released on $25,000 bail. Gentry and Klinck not found. April 3 —Stephenson named in five indictments returned by Ma rion County charging him with kidnaping, assault and battery, malicious mayhem, and with Gentry and Klinck, conspiring to com mit a felony. April 6 —Klinck and Gentry surrender and released on bond. April 11—Pleas in abatement for all defendants overruled by Judge James A. Collins in Criminal Court. April 14—Miss Oberholtzer dies. April 15 —Dr. John K Kingsbury relates Miss Oberholtzer’s story of the kidnaping and attack with which she charged Stephen son, the taking of poison at Hammond and automobile trip home. State forced to allow defense to read the alleged dying statement of Miss Oberholtzer. June 25—Judge Hines denies ball motion. June 27—Judge Hines sets trial date for July 6, and oreders a spe cial venire of 100 men drawn. Jupe 30 —Judge Hines grants de sense motion that Klinck be granted a separate trial. The defense claim:, this means Klinck goes to trial July 6. July 1 and 2—The State argues against such contention. July 3 —Motion by defense that Klinck be tried July 6, ahead of the other defendants overruled. Separate trial for Stephenson granted, leaving Gentry to be tried July 6, according to judge's ruling. Trial Postponed July 6 —Judge Hines rules the State has the right to choose which defendant shall be tried first Gentry and the special venire wait during arguments, ready for trial to begin. Prosecutor Remy elects to try Stephenson. Inman withdraws his motion for immediate trial for Stephenson. Judge Hines adjourns the special term of coure until the regular October term. July 16—Defense presents motion for rehearing on motion to be let to ball, claiming Miss Oberholtzer committed suicide. July 29—Motion overruled. Aug. 6 —Judge Hines refuses to accept defense motion for immediate trial for Stephenson. However, he calls a special adjourned term of court to hear motions in the case. Aug. 11 —The defense presents motion for change of venue from Judge Hines, which is granted, the judge expressing some bitterness at the way attorneys have treated him. Judge Will M. Suarks, Rushville selected special judge. Judge Hines adjourns the special term of court, saying no special judge can try the case until the regular fall term begins. Trial Date Set Aug. 14—Judge Sparks takes over the records In a conference with Judge Hines. During September, at another conference, the trial date Is set for Oct. 12. Oct. s—Stephenson and his secretary, Fred Butler, Klinck and Gentry, are indicted by the Marion County grand Jury on charges of conspiracy to burn the Stephenson home, on evidence presented by the State fire marshal’s office. Oct. B—Names of 100 men drawn by Hamilton County grand jury commission as special venire. Oct. 12—Trial begins at Noblesvllle. Oct. 28 —Jury obtained after 228 talesmen were questioned. Oct. 29 —State starts testimony. Nov. 4—State rests. Nov. s—Defense5 —Defense starts testimony. Nov. 10—Defense rests. Nov. 14—Case goes to Jury at 11:46 a. m. • Nov. 14—Jury returns verdict at 6:80 p. m., finding Stephenson guilty of second degree murder and freeing Klinck and Oentry.
