M'NAMARA CASE MOVES FASTER (Continued From Page 1) the iron workers were putting in kthe superstructure. ■ “When the second boiler was half *way down an incline into the basement, McNamara and a gang of iron workers appeared,” said Staggenborg. “McNamara said ‘What the H—are you doing down here," then he came over to me and said ‘I got a notion to knoe’.i your brain out!’ I said ‘Go ahead!’ ” McNamara was armed with a piece of iron pipe, according to testimony. “A little fellow with McNamara sajd: ‘Why don’t you do it, Mac?’ sfnd I said: 'Yes, why don't you come and do it?” Ordered Away “McNamara told us to get away from the job," said Staggenborg, “and he Vnade us release the cable which was holding the boiler on the incline. He sa!d: ‘l’ll knock the whole building down.’ At least twenty-five men came down with McNamara. Some had wrenches or anything they could get hold of.” D. C. Spotts, Detroit, Mich., em-' ployed by Freyn Brothers, which company had the job of setting up the boilers, after the Niman Company delivered them, was the first witness. He told practically the same story as Staggenborg. "McNamara said: ‘lf you don’t get off the job in peace we’ll drag you off. We’ll knock the jacks out from under this boiler and let her go.’ He knocked the jacks from under the boiler and I ran to call the police." Spotts said that after the boiler crashed down the incline a comMTiittee from the Elks Lodge and the Plrchitect asked that the work be held up until the local trades council heard the argument. The council awarded the work to the steam fitters, he said, and the boilers were later Installed. Reluctant Max L. Case. 637 Olive St„ employed by the Niman Transfer Company in 1923, proved a reluctant witness for the State. He could not remember what McNamara said, and in addition, volunteered the information that McNamara didn't threaten anybody, it seemed to him. On having his memory sharpened by a reference to his testimony hefor the grand jury, Case succeeded in remembering that McNamara said “You sons of—leave this work.” On cross examination by Charles E. Cox. leading attorney for the defense. Qase said he said he thought the incident occurred in warm weather. The indictment fixes the date as Nov. 15, 1923. George ICirkhoff, steam fitters’ helper, said there was “lots of cursing going on.” but couldn’t remember much else. Questioned by the prosecutor, he said the cursing was all directed toward the steam fitters ly the iron workers. Otto J. Danitz,23 N. Colorado Ave., union plumber on the work told his version of the affair, but refused to repeat the swear words. “I am not in the habit of using that kind of language,” he told Cox firmly. P Remy also reviewed briefly the -•history of McNamara, calling at tention to the fact he pleaded guilty to charges in connection with dynamiting buildings in the famous California labor war of 1910, when the Los Angeles Times building was bombed and twenty-one persons killed. Prosecutor Remy said he would introduce evidence to show that the Duesenberg plant was wrecked while being erected here after McNamara had repeatedly insisted that union iron w-orkers do the work. Judge Fred C. Gause said Remy could enter such evidence of prior h.appenings to show Intent on part o’ McNamara.

AUTO STRIKES CHILD Mt*her Prostrated Over Accident, Under Medical Care. Irma Gilchrist, 3, daughter of Mr. and Mrs. Charles Gilchrist, 143 Gelsendorf St., is in a critical condition at the City Hospital today suffering from a fractured skull. Police say she ran from the sidewalk front of her home and was struck >.y an auto driven by Samuel Higgins, 26, of 2911 W. Michigan St. Higgins was charged with assault and battery. Mrs. Gilchrist was prostrated and is under medical care. HOLD-UP MEN GET NO LOOT Couple in Auto Stopped— Thefts Reported. Two hold-up men failed to take loot from W. C. Weaver, 1463 Chester Ave., and Miss Jane Waltz, 915 Eugene St., after they held the couple up at Emerson Ave., and Sixteenth St., about 1 a. m. today. Weaver told police that he and Miss Waltz were driving when the bandit’s auto pulled up alongside. One man pointed a gun at Weaver. Miss Waltz dropped her two rings into the seat, and the men refused to take $4 from Weaver.' Other thefts reported: William Milton, colored, 738 Indiana Ave.. $300; Miss Nary Leslie. 754 N. Sheffield Ave., $2.50 and a ring: Mrs. H. K. Dunn, 2035 N. Meridian, purse and $9, and Miss Bernice Hamilton, 2076 N. Keystone Ave., $27 and a ring. LAWYERS TALK ON ADMISSIONS A corrml'tfi* of the Indianapolis Bas Association today took steps to tighten restrictions for practice before the bar. The committee, headed by James M. Ogden, city corporation counsel, met It recommended a committee of three on admissions be appointed by the Judge of the Marion Circuit Court, members to be recommended by the association. The committee would include a paid secretary, who would conduct examinations. Applicants for the bar would be required to submit their names thirty days prior to their examination.
