COURTS VARY UPON RETURN FOR UTILITIES Special Counsel Says Bell Hearing Will Disclose Interesting Facts. Decision of United States District Courts are at variance as to what constitutes a fair return on property of public utilities, Taylor E. Groningar, special counsel for the public service commission, who is conducting the valuation investigation of Indiana Bell Telephone Company, property, said today in commenting on the requested increase of Bell rates filed Tuesday. Increase from sl2 to sls in unlimited 'business service ami increases in measured business, measured rural and suburban business, and private branch exchanges in Indianapolis are asked in the petition. Indianapolis residential rates remain unchanged. General increases are asked for other excharges over the State. “The Constitution of the United States insures a reasonable return on the fair value of the property used in service of the public. There is considerable confusion In determining what is a fair value and a reasonable rate of return. Some court have held fair valuo should be measured largely by the investment in the property,” Gronlnger said. Rates Vary “Rates vary from 8 to 8 per cent. Reports of delegates to the convention of the National Association of Letter Carriers, recently held at Detroit, Mich., were heard Tuesday night by the Indianapolis Local No. 39 at the Chamber of Commerce. The newly organized postoffice band, which made an impressive showing at the convention, was commended. The local drill team w r on second place. One of the paramount Issues before the convention was the reclassification of the retirement law granting a thirty-year optional pension of $1,200. STREET PLAN GIVEN Gustav G. Schmidt, member of the city plan commission,— today announced that the opening of E. New York St. through Highland Park, from Arsenal Ave., to Randolph St., will he the first section of the New York St. opening and widening project.
