He had fled with Wilson and Mellenback in their automobile in a rain of police bullets from the hotel. Five miles north on the gold coast, their car crashed into a street car. The Eupreme Court last month reY’ersed the decision of*the Blackford Circuit Court and declared Mr, Ruth Werher elected clerk over \V, C. Hughes, who was holding the office under ruling of the local -court. In declaring Mrs. Werher ejected the Supreme Court permitted counting of absent voters’ ballets which did not bear slgnautre of the polling clerks. The Supreme Court took the stand that voters should not be deprive qf their franchise because of an oY’ersight of election officials. Hughes appealed for a rehearing and the brief completed by his attorneys contends the absent voters' ballet should lie thrown out unless duly marked.
