ANTI-EVOLUTION LAW IS UPHELD (Continued From Page 1) he would have to deal “as the law directs.” The trial, which started as a friendly test case in a carnival atmosphere, has reached the stage of being as scrappy an affair as any criminal case ever tried with both sides contesting every point. Tempers Tattered Tempers are torn and tattered. Already counsel have indulged in bitter words to each ether, reaching a peak late yesterday when Attorney General Stewart angrily shouted at Arthur Garfield Hayes, one of the defense counsel to “keep your mouth shut.” The defense has made an issue of the daily prayer in the court, even though some of the defense staff are frank to admit that it is costing their side many friends. They have introduced a petition on behalf of visiting non-fundamentalist clergymen asking that they be given equal representation with fundamentalist preachers in offering prayer. If the court grants this, it is the intention of defense counsel, however, to object to it. as they did to the other prayers. ' Argument Likely The ruling by Judge Raulston dismissing the motion to quash was expected to steady the proceedings, but by no means make a peaceful affair of it. Defense counsel intended to precipitate the long awaited fight over admissibility of evidence, despite the prosecution’s announced determination to resist the argument until later in the trian when .court resumed. I If Judge Raulston rules that the argument must wait, Attorney-Gen-eral Stewart and Dudley Field Malone will make opening statements for their respective sides as to what they expect to prove. The jury, which has been whittling sticks in the court yard for three days now, will at last be given a chance to sit in the trial. It will be sworn and 1 Scopes will plead not guilty. Half Day for Prosecution These formalities completed, the prosecution will put its witnesses on the stand. Attorney-General Stewart told the United Press today that it would take less than half a day to complete the prosecution’s case. The defense will then attempt to put a scientific witness on the stand and the battle over evidence, if not previously decided will be fought at this point. A defeat on this point by the defense means, according to the prosecution, that the trial will be over Saturday. Clarence Darrow will swing into action with his closing argument and William J. Bryan whom the natives have waited vainly to hear so far, will sum up for the other side.

Motives of Scopes Forces Revealed

Cochran Times Staff Correspondent DAYTON, Tenn, July 15. —Tuesday’s proceedings in the Scopes trial seemed to make clear the difference in motives controlling the conduct of the case by the prosecution and the defense. The motives of the prosecution are provincial; those of the defense universal in their appeal. The prosecution, with the exception of William J. Bryan, necessarily have in mind the opinion of the people of Rhea County and rural Tennessee. The defense has in mind the opinion of the world. To win by convicting Scopes means much by way of political popularity to the lawyers for the prosecution who if they run for office must run in the particular section of Tennessee. Dayton Awaits His Voice

This is William Jennings Bryan as he appears while stolidly listening to proceedings in the Scopes trial. Every line in his old face bespeaks determination. He has maintained silence, officially, so far, but was expected to participate in the Tig struggle today over the admissibility of scientific evidence on evolution.

Is overwhelmingly fundamentalist to the defense. The conviction of Scopes does not interfere with the purpose of the defense to test the constitutionality of a law which they believe interferes with religious liberty and is a blow at freedom of thought. In fact the convinction of Scopes makes it easier to carry the constitutional question to the Federal Supreme Court than would his acquittal. What the people of this Tennessee judicial district think about science religion and Scopes makes not the slightest difference to the aims of the attorneys for the defense yet it makes a vital difference to the political fortunes of Judge Raulston and District Attorney General Stewart, for they most get the fundamentalist votes in this section to be elected to office. Both Are Human This doesn’t mean that either is a small fry politician. Both are men of ability. Stewart is a clean-cut young lawyer of promise and Raulston a judge whose mind works quickly. But they can’t escape the human element in the case. The harder Stewart fights Scopes the better he will represent his fundamentalist constituents, and if Judge Raulston can honestly see the law as the opinions and prejudices of his constituents run he will gain in popularity. The strength of fundamentalism in and around Dayton is illustrated by some of the amazing court procedure. Opening court with prayer in this case is not unusual, and as practically all of the preachers are fundamentalists, there was little chance of getting any but a fundamentalist prayer. Lawyers Amazed Although Judge Raulston’s action if referring a motion to Invite other than fundamentalist preachers to pray to the local pastors association amazed lawyers for the defense. It didn’t amaze anybody locally even though all members of that association are fundamentalists But it does throw light on the background of the trial locally and shows a solid fundamentalist background. to the final outcome of the fight being made here by Clarence Darrow and his associates. The goal is the Supreme Court where the bill of rights In both the Tennessee and the Federal Constitutions will be tested. Dayton cuts no figure in the defense tactics. There never was any expectation of securing any but a' fundamentalist Jury. There was no hope of having the indictment quashed. There was no hope of acquitting Scopes. There Is hope of keeping the bill of rights Inviolate when the case gets to the Supreme Court and in the meantime and issues involved have been placed before the world. LOSES CAR FOR YEAR Motorist Draws Stiff Penalty on Drink Charge. Zenax Turner, 35, of 533 Kentucky Ave., must ride on street cars, or with his friends during the next year. In city'Court today Judge Dan V. White ordered Turner not to drive for one year, fined him $lO and costs and sentenced him to thirty days on the Indiana State Farm on a charge of driving while drunk.
