SHEPHERD CASE DEFENSE WINS LEGAL SKIRMISH Dismiss Juror Who Would Not Exercise ‘Extreme Caution/ Bv United Press CHICAGO, May 27.—Attorneys defending William D. Shepherd, former Indianapolis man, against charges that he murdered Billy MeCHntock with typhoid germs to get the hoy’s $1,000,000 estate won an important victory today in the selection of the jury. Judge Thomas J. Lynch ruled that Wlhiam Scott Stewart, Shepherd’s chief counsel, need not accept for jury service a man who would believe the testimony of "Dr.” Charles C. Faimen without “extreme caution.” The man was dismissed over the objection of State’s Attorney Robert E. Crowe. Faimen, who was president of an alleged fake medical school, L’confessed” he was an accomplice in the alleged murder, that he gave Shepherd the germs and instructed him how they should be used to cause Billy’s death. The Illinois law declares that a juror may convict a "man on the uncorroborated testimony of an accomplice, but warns that the jury should view the accomplice’s testimony with "extreme caution” before accepting it. Stewart, while questioning a prospective juror, found that the man would accept Faimen’s testimony “the same as anybody else.” HE MUST BEHAVE NOW Criminal Judge James A. Collins today withheld judgment and sentence during good behavior against Dale Littrell, 32, of 1828 W. Vermont St., when he pleaded guilty to embezzlement. Littrell was charged with misuse of SIOO belonging to the Fame-Armstrong Laundry Company.

CAVE-IN DOES DAMAGE Contractor is to Be Sued By City, June 26. Damage to city from cavein of Northwestern Ave. pavement near Thirtieth St., Saurday resulting from alleged cxca\ation by Michael Collins, contractor, 921 W. ’Seventh St., today was estimated at $650 by Francis F. Hamilton, city building commissioner. Collins will be tried in city court June 26 on charge of violating the city building code.
