STEPHENSON IN DEMURRER TO SUPPORT CASE Attorneys File Answer to Suit of Alleged Former Wife. Another move in the legal battle of David C. Stephenson in Superior Court One was recorded today following Tuesday afternoon of a demurrer to a suit for approximately $17,000 support money, brought against Stephenson by Mrs. Nettie Stephenson Brehm of Poteau, Okla., who claims to be his former wife. Demurrer was filed by R. E. Johnson and A. F. Cowan, attorneys for Stephenson. Stephenson, former head of the Ku-Klux Klan in Indiana, is in Hamilton County jail at Noblesville, Ind), with Earl Gentry and Earl Klinek, his aids, charged with the murder of Miss Madge Oberholtzer, 28, of 5802 University Ave. Change of vpnue from Marion County was granted Saturday by Criminal Judge James A. Collins. Mrs. Brehm, her husband, Homer Brehm, and Florence Catherine Stephenson, 9, said to be Stephenson’s daughter, are seeking to collect the money. Complaint filed March 18, 1925, alleges Stephenson has never contributed to the child's support. Mrs. Brehm alleges they were divorced shortly after their marriage. Demurrer cites four reasons why it should be sustained Reasons are: The complaint does not state facts sufficient for cause of action; defect of parties, alleging only Mrs. Brehm has right to sue for support money; several causes of action have been improperly joined, and plaintiffs have not legal capfigity to sue Stephenson. I Judge James A. leathers indicated he would take no immediate action on the demurrer. Should Judge Leathers uphold the demurrer, the complaint would be dismissed.
