HILLIGOSS CALM IN SHADOW OF , ELECTRIC CHAIR Smiles as State Evidence in Murder Case; Claims Defense. Bv Times Special NEWCASTLE, Ind., May 16. Alvin Hilligoss, Greenfield, Ind., taxi driver, facing trial In Henry Circuit Court, at Newcastle, on the charge of murdering Henry Roberts, jof Greenfield, a World War Veteran and husband of Nellie Roberts wh< se affections Hllligoss Is alleged to have alienated while Roberts was across with the American forces, Is sitting through the days In court with a peaceful smile on his face, as he hears the State slowly unreel its vast mass of evidence. The State rested its case Thursday. Hilligoss was expected to tak& the stand today. On Armistice Day Roberts was shot by Hilligoss on last Armistice day, Nov. 11, 1924, on a lonely road north of Greenfield, when the former came upon the Hllligoss car, parked along the road, with Mrs. Roberts and Hilligoss in the rear seat and Ida King of Greenfield sitting behind the wheel. The State contends that when Roberts stepped on the running Aboard of the car to peer In, Hilligoss "drew a 46-caliber revolver and fired twice, without any further provocation. Hilligoss Is pleading self-defense and alleges Roberts crawled into the car and was choking him when he reached In the pocket of the car and pulled the gun with which the fatal shots were flrpd. Wife Flees Mrs. Roberts has fled and will not likely testify in the case. Ida King, the other member of the trio in the car, left the machine when Roberts approached and declares she did not see what took place. At Greenfield, the county seat of Hancock County, from which court the case was venued to Henry Circuit Court, feeling is strong against the defendant. He was convicted there, some months ago, of transporting liquor. The case Is expected to reach the Jury early next week. CHURCH SESSION ENDS i Methodist Ffrotestant Conference Comes to Close. SECOND BUS OPINION Gllluom Gives Test for Determining Carriers Not Under Law. In a supplementary opinion on regulation of motor busses and trucks by the public service commission, Attorney General Arthur L. Gilliom, Thursday, set forth a series of tests for determining carriers that do not come within purview of the law. Gilliom held it not the intention of the commission to regulate farmers using their trucks occasionally for hauling live stock, grain or milk for hire.
