WILL TEST ANTI EVOLUTION LAW IN TENN. COURT Biology Teacher Arrested for Teaching Descent From Lower Forms. Itu Times Special DAYTON, Tenn., May B.—Legal action to determine whether or not the State of Tennessee can prevent the teaching of evolution in the public schools will begin Saturday. J. T. Scoaps, biology instructor in the local high school, is under arrest with telling *his pupils that man is not a divine creation, but the product of evolution from the lower animals. The proceedings will amount to a friei.dly suit which will be carried to the Supreme Court, in case Scoaps Is convicted, so that the recently enacted law against the teaching of evolution can be passed upon by the highest authority. It is believed that Scoaps will be found guilty in the lower court. The Tennessee law is the only statute prevening the teaching of evolution, but in Florida and North Carolina the respective State boards of education have imposed regulations having the same effect. The Tennessee act became a law March 23, of this year. It provides that: ''lt shall be unlawful for any teacher in an institution supported by State funds to teach any theory that denies the story of the divine creation of man as taught in the Bible, and to teach that man has descended from a lower order of animals.” New Train Available Here T. Carpenter, city passenger agent for the Louisville and Nashville Railroad Company, 310 Merchants Bank building, today said the Pennsylvania train which leaves Indianapolis at 7:45 a. m. makes connections with the L. & N. train at Louisville, Ky. Carpenter said the "Pan-American” is the first trian, carrying modern accommodations, to New Orleans, La. The Ford Motor Company is establishing an assembling plant in Japan.
