STEPHENSON IS BEHIND BARS (Continued From Page 1) with a 125,000 bond hanging over his head as result of previous indictments, charging assault and battery with intent to kill, kidnaping and mayhem. Early today. Sheriff Hawkins still was calm. He said he awaited Stephenson's appearance because newspapers had announced Stephen son and his aids would show up today. Meantime, Prosecutor William H. Rem.v prepared to Institute an Investigation of the three-hour delay on the part of the sheriff's office Saturday In making an effort to serve the capiases for arrest of the three men. The Indictments were returned a’ 11:50 a. m. Saturday. Capiases were turned over to the sheriff's office within a few minutes. It was about 3 p. m., when Sheriff Hawkins started searching for the men. Remy said he had not started the investigation, but would begin inquiring into the delay as soon as possible. At the jail Sunday it was said that all but three deputy sheriffs were combing Indianapolis and vicinity for Stephenson. Hawkins himself had gone to Martinsville Saturday, it was said, to return some prisoners charged with automobile theft. From the time indictments were returned it was common gossip about the court house that Stephenson. Klinck and Gentry would not t>e found before today. "They will not spend Sunday in any jail." a courthouse employe said. "You can hank on that. They will show up when they think they can have some chance of making habeas corpus proceedings stick and being admitted to bail." Throngs of curious persons visited

Stephenson’s home, 5432 University Ave., Sunday. The house was badly damaged by fire early Friday. Police and fire officials say the blaze was of incendiary origin. So many automobiles were in the narrow street that at times traffic was jammed for a block in each direction. The crowd swarmed over the spacious lawn, peered through the windows shattered by the force of the explosion with which the fire originated, tramped over the lawn, looked into and -over the garage and thoroughly inspected the place. Policemen were on guard. "^ T ere It not for them the crowd would carry off the whole place for souvenirs," a spectator declared. According to the story told by Miss Oberholtzer to her parents and Dr. John K. Kingsbury, before her cPath last Tuesday, she was lured to Stephenson's house on the night of March 15. forced to drink something, kidnaped, taken to a train for Hammond, lnd., and assaulted. At Hammond the day following she procured poison and took it. Ste phenson and other men then brought her back to Indianapolis by automobile. she said, refusing her medical attention on the w’ay, kept her prisoner until the morning of March 17. when she was taken to her home. The story is embodied in the murder indictments, whlcn are in four counts. Stephenson also Is under indictment charged with kidnaping assaulting and committing malicious mayhem upon Miss Oberholtzer. Together with Klinck and Gentry he is charged another indictment with conspiracy to commit a felony. A fund has been started by citizens of Irvington "in bring to justice any guilty parties ronneoted will) Hie death” of Miss Oberholtzer, according to a statement today by Thomas Carr Howe, former president of Butler l niversity. The money will not be used to engagp legal aid. Howe said. A number of persona have asked him to receive contributions he said.

Howe's statement: “A movement which originated among people in Irvington has been under way for two or three days for the purpose of assisting the authorities in every way possible to bring to justice any guilty parties connected with the death of Miss Madge Oberholtzer. Many people from all parts of Indianailis, as well as Irvington, have already joined In this movement, which is not confined to any part of th city or the State. "Those interested in this matter have the greatest confidence in William Ferny, prosecuting attorney of Mqrion county, who must bear an especially heavy load in the prose cutlon of so Important a case as this. We understand that attorneys now engaged by the Oberholtzer family are in the case without incurring any expense to the State It is realized that Prosecutor Remy needs the barking of all good citizens and should not be expected to prepare the case unaided. It is felt that assistance is needed in follow ing up certain details of the case, and that is the reason citizens are eagerly volunteering their support to the attorneys w’ho are aiding the prosecution. Os course, whatever assistance of this kind that can be rendered will be supplementary to the efforts which are fully expected from the official authorities of Marion t'ounty."
