DR. J. N. HURTY CALLED BV DEATH / • (('onHnutyt From Page 1) relenting, wholeheartedly and without stint.” Treasured Friendship One of the treasured memories of Dr. Hurty was the friendship of Dr. Alexander Graham Bell, inventor of the telephone, who died several yeers ago. Dr. Hurty told of his friendship with Dr. Bell sometime before his deail; and asked it be used in his obituary. Ths acquaintanceship of the two men began at a New England health resort. A chance meeting developed an unusual friendship. Annually thereafter they met in the East to discuss scientific problems and relate the experiences of their work. Dr. Hurty was frequently a guest in the Bell home in Washington, D. C. Funeral services for Dr. Hurty probably will be held Monday, it was said at the home. Arrangements are being held up awaiting word from Frank W. Hurty, a brother, of St. Paul, Minn. Burial will be in Crown Hill Cemetery. Dr. Hurty was a thirty-second degree Mason, being a member of the Mystic Tie Dodge, No. 398. He was also a charter member of the Columbia Club, and belonged to the University Club, the Contemporary Club and the Literary Club. Disappointment Defeat of the full time health officer measure of which Dr. Hurty was author, in the 1923 Legislature probably was the greatest disappointment in his liflp. When the bill wVs voted down Dr. Hurty rose to his feet dramatically—but could not speak. Heartbroken ovei the 'defeat of efforts of more than a quarter century, he left the Chamber. His race for election as Republican Representative from Marion county was based on the hope to enact the measure. . Although members of the 1923 Legislature acknowledged the bill as one of the most progressive studies in public health betterment ever attempted by the State, the bill went down to an inglorious defeat. Legislators argued it was too revolutionary. Widely Indorsed From all quarters of the United States the measure was championed by public health officials. , Gradual improvement of . health conditions in the State has beer attributed to the fight of Dr. Hurty before the Legislature. At nearly every session of the State Assembly he proposed some progressive measure.' In 1899, Dr. Hurty obtained passage of the first pure food and drug act, enacted in the United States. The law became a model for other States and eventually was passed by Copgress. Other Laws • Other laws which Dr. Hurty sponsored were: Quarantine law, 1903. the sanitary food law, a i~w for the sterilization of the* unifi*. 1907 (declared unconstitutional by the State Supreme Court, 1921(; a law defining nuisances, 1913; sanitary schoolhouse law, 1913; medical school inspection law. 1911; Infant blindness law, 1911; hydrophobia law, 1911; anti-rat law, 1913; renovated butter law,, 1911; clean milkcan law, 1913; hyglujne laboratory law. 1915; and the antitoxin law, 1919. For a few minutes he sat in the speaker’s chair in the Senate Chamber, when visiting the last seventy fourth Assembly a few days before it adjourned. Tribute Paid

"There is not a spot in Indiana which has not been influenced by the life of Dr. Hurty,” said Dean Frederick It. Henshaw of Indiana Dental College, Pennsylvania and Walnut Sts., whc has known Dr. Hurty for thirty years. He knew dentists In every town In Indiana and kept in touch with their activities. His interest in dental education began in the early eighties. In 1881 he became teacher of chemistry at Indiana Dental College and was professor, of chemistry until the time of his death. As president of the board of trustees for more than thirty years, Dr. Hurty had an active interest in the Institution as a whole. For years he worked for the combination of the dental school with Indiana University School of Medicine. Victory for Him Recent action of the legislature for union of the two schools was the result of. his years of effort. Dean Henshaw said only a few days ago Dr. Hurty expressed joy over the plan to merger the institutions whe hhe called at the dean's office for a little chat. “Whenever he came to the school hfl would drop in my office and we would talk fifteen or twenty minutes no matter how busy I was. His constant flow of bright remarks accumulated into grains of philosophy. On the last occasion Os our meeting we congratulated each other over the merging of the schools,” said Dean Henshaw. "Interest in all activities of the dental profession manifested by Dr. H'rty Is seldom found in a person who is not a dentist. During the forty-three years he served the institution there were more than 2,000 students who came under him. They were greatly affected by his illustrious life. Was Far Seeing JBbr. Hurty was progressive. He always thought ahead of his time. There was a man who did more for his hobby. Nothing too laudatory couid be said of him, because he persistently hung to the Idea of advancement. He was always on the spot whenever there was an epidemic. He fought day and night for the citizens of Indiana. * "Although his life was crowded with public work, he did not slight his family. He was a loyal and devoted husband and consistent in private life.

Ferdinand Gorgas, for years surgeon general of the United States Army, and widely known medical authority, as a patient. "When he learned that I knew Dr. Hurty he said: ‘When you go back to Indiana tell them that in my opinion Dr. John Hurty has done as mucj) for public health of America as any man who ever lived.’ ” Amazing Vitality An amazing amount of vitality was possed by Dr. Hurty. He was able to accomplish a great deal more than the average person in the same amount of time. For many years he lectured daily at the Dental School and Indiana Medical School. Teachers in both of the institutions give their time gratis. He was one of the great supporters of mouth sanitation and sponsored" the movement for public health dental clinics for public schools. “Dr. Hurty rendered an outstanding service-to public health in Indiana,” said Dr. S. E. Smith, provost general of Indiana University. “As secretary of the board of health he was a pioneer and secured legislation in matters of public health which placed Indiana in the front ranks of States in matters of general welfare. “He was some times regarded by his old friends end acquaintences as a crank, and he admitted it," Dr. Smith continued. “But it took such a positin to make him a leader in sanitary science. He was a leader, and led in the right direction. His influence will be long felt and Indiana owes him -a great debt of gratitude.” life Not Burden Public life was not a burden to Dr. Hurty, he seemed to enjoy the various activities In which he participated, according to his son. He attacked each problem as it came, and took delight in the fight for advancement. What time was not consumed- by public work was spent at his home. Following dinner in the evening he would read the daily papers, study and write until about midnight. He usually arose about 7 a. m. During the influenza epidemic in 1018, Dr. Hurty assumed charge of organization work and wa~ personally responsible to rstifling the threatening inroads the disease was making on the population.

MAN STRUCK BY AUTOISINIURED Officers Take Several on Driving Charges, Roily Rolland, 38, of Bio Harmon St., was cut about the head and injured about the back when he was struck by an auto said to have been driven by Carl Butcher, 27, of 1418 Central Ave., north bound on Madison Ave., near Delaware St. Butcher was charged with assault and battery. Rolland is held in the detention ward of the City Hospital charged with operating a blind tiger, officers claiming he had liquor on his person. Witnesses say Roosevelt Pursely, 23, colored, 2910 College Ave., overran the traffic signal at Thirtieth and Meridian S*., and collided with an auto driven by Guy King, the Roosevelt. Kmest Atherton, the Broadway, was injured. Pursely was charged *vith assault and battery and failure to obey a traffic signal. ) Dr. Jo, a Carter, 76, of 424 N. Delaware St., was crossing the street at Alabama and Massachusetts Ave.', when he was struck by an auto driven by Thomas McCormack, 1514 Sheldon St., and injured about the face and shoulder, police say. Autos driven by Mrs. Ida Denton, 77 E. Thirteenth St. Emil Adelman, 18, of 943 Maple St., collided at Broadway anfl Thirtieth Sts., injuring John Denton. Adelman was charged with assault and battery. TWO REPORT PROWLERS Police Called When Men Are Seen Near Residences. Two "peepers" kept the police busy Thursday night. Miss Dorothy Kruse. 737 E. Mrs. Duckworth could not identify him. SENTENCE SUSPENDED ✓ N Man Escapes Fine and Term on Appeal Cliff Milem, 40, of 1109 E. Maryland St., who was fined $lO and costs and sentenced to 180 days on the Indiana State Farm in city court Sept. 15, 1924, for petty larceny, succeeded in having his sentence supended Thursday afternoon when he appealed to Special Judge H. B. Pike in Criminal Court. Detectives said Milem took merchandise valued at $156 from the Standard Grocery Company for whom he was an employe. Annual Show Presented Eight Butler University sororities and fraternities presented their annual vaudeville show in the chapel this afternoon. The entertainment will be repeated tonight at the conclusion of which a silVer trophy cup will be awarded the organization giving the best performance. Safe crackers entered the Buddenbaum Lumber Company, New York and Pine Sts., Thursday night and battered the handle off the safe. They wers unable to get in to the inner compartment, police say. State of Indiana, That the construction oi a local sewer, intended and adapted only for local use by the property holders whose proper ty abuts thereon, and not intended or adapted for receiving sewage from collateral drains, be, and the same is. hereby ordered in and along DEWEY AVENUE From Arlington Ave.. To a point 415 feet east. More particularly described ae follows: Beginning at Sewer in Arlington Ave., at Dewey Ate.; thence cast in Dewey Ave.. to a point 415 feet east. Said sewer shall consist of Vitrified pipe 12 inches in diameter, and ' said sewer, with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said city. The cost of said improvement shall be apportioned arntnst and paid by the property holders whose property abuts thereon, and upon the city of Indianapolis, if the city is benefited by said improven ent. all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Com>erning Muncijpal Corporations," approved March 0, 1905. Aasesßments .if deferred, are to be paid in ten equal annual installments, with interest at the rate of 0 per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued.
