BRITISH COUNCIL DEEMS CANADIAN STATUTEINVALID ' ** Holds Important Legislation Settling Labor Fights Unconstitutional, By William Philip Sims WASHINGTON, March 27.—Just as Canada was beginning: to feel herself free of the apron-strings of her mother country, she has been jerked back to the cold fact of her dependence upon England with a suddenness that has left her startled and angry. The Imperial Privy Council, sitting in London, has Just declared the Candian leglsltion known as the Industrial Disputes Act is unconstitutional. For seventeen years the statute had been in force. Experts have called it the mose effective strike-prevention measure in the No less than 441 Conciliation Boards had been appointed under It* authority and in all but 87 cases it had prevented strikes. In hundreds of other cases it was influential in settling labor disputes wlthous even the appointment of a board. Now, though, upheld by the highest' Canadian courts, the privy council In London has dealt it a death blow. Nothing in a generation has created more resentment in Canada. And the resentment is rather more than a little tinged with fear, for the London decision places Canada’s very status as a self-governing dominion somewhat in doubt. Canadians Bewildered The Canadian government is up in the air as to its power to deal with civil and property rights within the Dominion; to call out troops to protect such rights; to take steps to regulate hours of labor, or even Just how far it can go in its dealings with the various provincial governments. Unlike Australia and South Africa. Canada seems impotant to effect a remedy. The sister dominions can alter their Constitution ■when advisable. Canada cannot. It was given to her by the British Parliament and only the British Parliament can change It. This the Parliament presumably would do upon unanimous representations from Canada, but national unanimity Is rare, whether in Canada or in any other country. The Industrial Disputes Act——popularly known as the Lemleux Act, ‘after the premier under whom It was passed—was designed to deal with labor disputes In public utilities. Either party, employer or employes, could ask that a board be named, and the other would be bound Miot to resort to a strike or lockout until such a board had investigated and reported. The employer would name one member of the board, the employes one, and the two—or the Federal Government in case these could not agree—would name a third. Award Is Optional After the award had been made, either party was then free to reject it and call a strike or lockout. In actual practice, however, extending over a period of seventeen years, the system proved very satisfactory to all parties. Amazingly few disputes ever reached the lockout or strike stage. Not until 1024 was the act challenge'l. The publicly-owned Ontario hydro-eleotHc commission took the matter to court when the government, at the reonest of a body of employes, insisted upon appointing a hoard. The company claimed the act did not give jurisdiction to the Federal Government. The Courts of Appeals of Ontario ami Quebec pronounced the act valid but the privy council, sitting in London, and with no Canadian Judge taking part, reversed the decision. Canada is expected to appeal for a reopening of the case and further argument. Meantime publio opinion In Canada is wrought up over the matter p it has not been in a generation.
