COMMITTEE AGAIN REJECTSWARREN (Uowtinued From Page One) nssn, Illinois; GlUstts, Massachusetts. Againut Warren (9), Republicans 2—Borah, Idaho; Norris, Nebraska; Democrats 7—Overman, North Carolina; Reed. Missouri; Ashurat, Arizona; Walsh, Montana; Caraway, Arkansas; King.. Utah; Neely, West Vlrfinla. The full membership of the committee was present. Walsh presented a resolution to the committee expressing the opinion that the President’s act in resubmitting the nomination was unconstitutional. He said It merely expressed his opinion and did not ask a vote. H*9o)utlon Presented Th# reeolutlon: •*l. The President of the United States la without constitutional right or authority to submit to the Senate a nomination for public office here tofore at the same session rejected by the Senate. “3. That the rules of the Senate eg well as fundamental principles of parliamentary law forbid the conslderatlon by the Benate of a nomination so re-submitted. “3. That it Is incompatible with the dignity of the Senate t entertftJn a nomination so submitted.” Walsh said he would ask the Senate to decide this question when the nomination comes up for debate. Determined to establish once and for all absolute right of a President to select his own Cabinet, President Coolldge today marshaled every Administration force in the Senate to drive through on the second attempt a confirmation of Warren. Coalition Plans Speed But, flushed with the tion of a second victory, the Democratic ooalitlon of Senators opposed to Warren prepared to repudiate the renomination with as much speed and precision as the President showed In resubmitting It after it had once been rejected. President Coolldge today summoned to the White House Senator Borah. Idaho, chlaf opponent to Warren to confer with him on the conflict between the Administration and the Senate. Two “Called In’* Just before Borah arrived. Senator McMaster, South Dakota, another Republican Senator who voted against Warren, was also called to the White House to discuss the situation with Coolldge. After the conference with the President McMaster said they had discussed “the Warren situation in a general way.’* He declined to say whether or not the President had urged him to change his vote against Warren to one In favor of confirmation but be asserted he knew “of no prospective ohange among any of the Senators who had voted against Warren, the first time.” Marriage Licenses For*l J.
