DEFENCE SCORES IN RON! CASE (t’ontinned From Page 1) whether or not it was in tgood faith at all," insisted Wiltsie. Judpe Collins ruled that all the defense could do would be to convey, to the jury that Hunt repaid the SIO,OOO and let them determine whether or not it was a legal loan. Repayment Unimportant "Gentlemen you ’ can't gret away from the fact that this SIO,OOO waa loaned by Sipe to Hunt," said Judge Colllna. "If thi* money was from trust funds in charge of Sipe and illegally loaned, then these men are guilty of conspiracy. It makes no difference whether the money was ever repaid or not.” " Sipe admitted, on cross-examlna tion by Eph Inman, defense attorney, that he understood the $1(l000 was repaid by Hunt. “Waa there any agreement or conspiracy in your mind or In the minds of Hunt and Latta, as far as you know, to embezzle -this SIO,OOO for your own u*e r ‘ said Inman. Here Remy objected and cited that Sipe had entered pleas of guilty to two former indictments on embezzlement. "Must this man’s technical plea of guilty reflect upon this other defendant and lead him Into the penitentiary?" asked Inman. Attorneys Clash Remy Insisted that Sipe had already made his plea, which waa now court record, and waa bound by It. **lt’s poisonous to the Jury,” declared Inman, pointing to the Jurors. "That this man pleaded guilty at a former trial because the crushing stone of evidence was upon him ought not to be used In this trial I’ll ask the court to admonish the Jury not to consider the remark# of counsel." Judge Collins sustained Inman. Again Inman asked Sipe if he conspired with Hunt and Latta to era bezzle the oounty money. Sipe an swered “No." Upon objection of Remy the State was sustained and the answer stricken from the records. Throughout the trial Latta and Hilnt, who are brothers ln-law, sat beside each other, behind their attorneys Latta took a deep Interest In the proceedings, occasionally conferring with Inman and Wiltsie. He smiled at every clash between the prosecutor and defense attorneys. Hunt ssemed to take less interest in the case. He leaned back against the railing and shaded his face with oiis
