NEW LEGAL STEP 10 BE TAKEN TO ‘SAVE’ CLAYCQMBE =_ Attorney Says High Court Not Concerned With Who Is President, Declaring that Supreme Court had not gone into the question of whether Lloyd D. Claycombe, or Ben H. Thompson wa a the legally elected president of the council, Arthur Robinson, attorney for Claycombe, tCday announced new legal procedure would be started in Claycombe’s behalf. Exact nature was not made public until after a conference with Claycombe. "Our contention has always been and is now that Claycombe is the only legal president' of the council,” said Robinson. “There can be -no other election at the time and place Claycombe was named.” Explains Court’s Stand “The Supreme Court went on the broad ground that tha council was a legislative body, and could not be interfered with by a court in its legal procedure,” said Robinson. “But it did not go into the question of legality of Thompson’s election. Robinson said Claycombe would be represented at the Supreme Court hearing Jap. 13 to decide whether the writ should be made permanent restraining lower courts from interfering with the council. Claycombe today said he had no statement until after conferring with Ids attorneys. Meanwhile the writ served to put the two factions together long enough to vote unanimously to suspend rules on passing important measures Tuesday evening, Counailman John E. King was unanimously elected president pro tern. “There will be nothing more 'this matter,” said James M. Ogden, corporation counsel, today. “Thompson has been duly elected.” George Abraham, sheriff of the State Supreme Court, read the writ on order of Ben H. Thompson, in the president’s chair. The council Chamber was crowded. Claycombe, standing near by, immediately asked for the ’floor and was recognized. “I have just come from the Supreme Court, and that court prohibits further restriction in this matter,” said Claycombe. “It is my will to bow to the Supreme Court. I am disposed to conduct the business of the council in an orderly manner, and I knoxy that is the desire of my associates whd supported me.” He was applauded. Later Councilman Ray obtained the floor, and announced it was ‘the greatest pleasure in my life to vote for Mr. Thompson for president.” ** “His word is worth iw weight in gold,” said Ray. More applause greeted this remark. Ordinances passed were: Authorizing a temporary loan of $200,000 for the board of health; appropriating $450 for s.ilary of the boxing commission; providing for a new wing at the municipal-grarage to cost $106,000. Contracts have been approved by the board of works. Claycombe cast the lone dissenting vote.

' The sun will be in total eclipse on a path running northern Wisconsin and Michigan with a southeasterly swing across southern New York, norhtwestern Pennsylvania, northern New Jersey, Connecticut and Rhode Island Almost Total Here As for Indianapolis, the eclipse will be about 93 per cent total, according to Russell Sullivan, Indianapolis amateur astronomer. Whisky flasks have been stored away until the storm blows over, and the bare mention cf spirituous liquors is forbidden within a hundred yards of the House of Representatives. * Here in the Paris of America, where Congressmen live higher than aviators, acoerding to Mrs. Scott, the gabbing tongues have suddenly stopped. ' “Shush! Don’t drag me into this mess,” is the parting word of Congressmen as they dive for the storm cellar. Even the address of “The Boar’s Nest” has been lost. Even No Cider Representative Hill of Maryland recently figured rather prominently in a liquor technicality case, but does he know anything about the flow of whisky about the capital? He never heard of it. “Is there really much drinking among Congressmen," he was asked. “I don’t know a thing about it.” “How about cider parties in the Capital?” But the Congressman was fifty feet down the corridor and the question went unanswered. Waiter Gingery, astronomy teacher at Shortridge high school, said. This, he eplained, ja because west of a line passing close to Cincinnati and Toledo, Ohio, the eclipse will be under way when the sun rises. East; of that line the entire course of the eclipse will bo visible. Must Wait 200 Years Indiana is not a favorite playground for total eclipses, Gingery said, and it will be at least 200 years before there Is a total eclipse in this State, he said. There will be four partial eclipses, two of the sun and two of the moon this year, Gingery said. Two will be visible in Indiana, that of the sun Jan. 24, and one of the moon at about midnight Feb. 8.

Scott and central figure in the divorce scandal that was recessed at Alpena, Mich., Tuesday, was to arrive here today for a few days’ rest before going to Washington an-’. New York to aid in taking depositions in her behalf. The trial will be resumed March 10. Promising the fight has just started, Mrs. Scott boarded a train at Alpena Tuesday after issuing an informal statement declaring she “would tell everything on Washington society and its night life.” Scott remained at his Alpena home. ELECTION UPSET GREASES WAY TO FAIR BOARD JOB E, J, Barker, Retiring as President, Slated for * Secretary, A complete upset in the election of members to the State board of agriculture today left the way open for election of E. J. Barker of Thorntown, retiring president, as secre-tary-treasurer to succeed William M. Jones, Fairmount. Barker, representing the Ninth district, was not even proposed for re-election on the board, contrary to the supposition that he would run unopposed. C. Y. Foster, Carmel, Ind., was nominated, the nominations immediately closed and - his election made unanimous. Barker Free Since no board member can be nominated and elected secretary, Barker is free from such complications. It was believed he would be elected secretary late today. Harry Moberly, defeated for reelection to the board from the Sixth District by Russell G. East, Shelbyville, was also a candidate ,but was not expected to make any showing. Roy Graham, Franklin, defeated G. R. Kemper, Columbus, for election from the Fourth district, 44 to 37 . Graham is said to be backed by the Ku-Klux Klan. Gwemor Gives Welcome O. L. Reddish, Fifth district, and Lin Wilson, Eleventh district, were elected without opposition. Linn Wilson, Eleventh district, ivas slated for president, and S. W. Taylor, Booneville, vice president. Governor Emmett F. Branch opened the meeting with an address. Mayor Shank spoke urging construe tion of anew grand stand at the fairground, and commending the board on the last State Fair.
