i to face a charge of embezzling $lO5, was held today by Superior Judge Sidney S. Miller. Thomas E. Garvin, attorney for Keyser. charged that his client was smuggled out of Indianapolis by City Detective Michael Sullivan and a Memphis detective, J. C. Kennedy, in defiance of habeas corpus proceedings before Judge Miller. Deputy Sheriff j Harry Jackson jumped on the runI ning board of the automobile in which the two detectives held Keyser ; and read them the summons, Jackson i said, hut they pushed him off and ! drove away into the dusk with the | prisoner. After Sullivan said that the Tennessee detective was responsii le for j the failure to obey the summons, the i ..udge let him go with a warning. According to the habeas corpus complaint, Keyser was arrested Jan. j 23 on telegraphic advice from Mem- ; phis that he was charged with embez- ; zling $lO5 from a store of which he was formerly manager. He was later arrested on a warrant i issued by Governor McCray honoring requisition papers from Tennessee. This was illegal, Garvin said, because the warrant was signed by Miss Ada Bush, the Governor's secretary,. in stead of the Governor. A later warrant by McCray was issued. Keyser was at liberty Jan. 31 on bond obtained by his lawyer, and obtained a license to marry Miss Ada Frantz. 3625 Birchwood Ave., but the record in the county clerk's office shows no return of the marriage certificate. as he was rearrrosted almost immediately. Identification proceedings were held for Keyser by the detectives before Criminal Judge James A. Collins jusfe before lie was removed from the city. Judge Collins found Keyser was the mar, wanted, although the defendant strenuously denied being In Tennessee Oct. 1, the date on which he Is charged with taking the money.
