BILL WOULD HAVE JURY HEARING IN CONTEMPT CASES Idea Calculated to Curb Federal Judge’s Alleged Tyranny,* By LOW'ELJj MELLETT WASHINGTON, Dec. 27>-Jury trial Is the remedy for the tendency of Federal judges to exceed their proper powers under the present contempt of court law, according to Senator Kenneth D. McKellar of Tennessee, author of a bill providing this cure. He hopes to get action in the present session of Congress. McKellar would not restrict the power of Federal judges to punish for contempt committed in the courtroom or within the hearing of the judge on the bench. But this. In his opinion, is as far as a judge should go without being upheld by a jury. The Senator fears a growing assumption by judges of the power to stifle criticism' outside the court as well as within. Two Supreme Court decisions he has in mind are those upholding the actions of Judge Killits in Toledo, and Judge Mayer in New York. In each case the judge inflicted a penalty for criticism appearing in a newspaper. The alleged contempt, in each instance, was clearly outside the presence of the court and, McKellar believes, properly calls for jury trial “The dignity and orderly proceedings of the court must at all times be maintained,” said the Senator, “but when the court uses the power to punish for contempt to enforce preliminary' orders without trial on the merits and without hearing both sides, it seems to me well enough that the court in such cases should be backed up by the flnidings of a jury. Such a course would make for the more orderly administration of justice in our courts. It would square with the American idea cf justice and with the American Constitution, guaranteeing the sacred right of trial by jury.

"The Dance of Life,” quotes Einstein and the theory of relativity in support of his own theory that life must be regarded as a fine art. Therefore, the reader may indulge me if I wander from the field of science into that of philosophy. My excuse is that I had a most excellent guide—Hendrik Van Eoon, author of the "Story of Mankind" and the newly published "Story of the Bible." A drizzling November rain was falling. and when it rains Van Eoon waxes philosophical. He admits it. "I always go back to Spinoza,” he says. “In the arid wilderness of modera philosophy he is the only oasis where pure and unadulterated water can be found by those lucky enough to discover the hidden source. "Professors who hold chairs of philisophy. as far as I have been able to discover by a clear perusal of their famous works, avoid this dreaded spot where the subtle light of a crystal pool is apt to reflect their own poor countenances with startling and shocking reality." • • • "If Spinoza could distill the absolute and the infinite out of mathematical formulas, we ought to be able to do the same with the present state of society,” said Van Loon. SOX LACKED HARMONY Cliques Formed During 1923 and Caused Team to Slip. Those on the Inside say the failure of the White Sox to finish better than seventh in the American League during 1923 was due to cliques on the ball club. Several of the players, are alleged to have suffered from the belief they were being discriminated against, and as a result did not give their best efforts. Among the disgruntled athletes was mentioned a clever outfielder and a capable pitcher. Under Frank Chance, who rules with an iron hand, this condition is sure to disappear, or elsfe the peeved athletes will be wearing different uniforms.
