CADLE INJUNCTION HEARING SEE FOR MONDAY BY GIVAN Use of 'Gypsy Smith' by Overmeyer Choir Protested, Right to the title "Gypsy Smith Choir” will be determined by Judge Clinton H. Givan in Superior Court Monday. Two factions of the Cadle Tabernacle are involved. An injunction suit to restrain Gypsy Smith Choir, Inc., from using the name w&s filed in Judge Givan’s court Thursday. Joe Overmyer, resigned leader of the tabernacle choir: James W. Fisher, Harry L. Jenkins, Jesse G. Beck and Will C. Hitz were named defendants. The petition was asked In the names of Clarence Lawson, representative of Howard S. Cadle, and the following officers of the tabernacle choir: George P. Tomlinson, vice president; Mrs. Edward P. Schort, secretary: Joseph Stacy, treasurer, and H. C. Moore, chairman of the finance board. The suit was the outgrowth of a split that occurred following the Bulgin evangelistic meetings at the tabernacle several months ago. The Gypsy Smith Choir, Inc., claims to have fully half of the 1,600 members of the old choir. TERRE HAUTE GIRL ALLEGESASSAULT Illinois Publisher Held in Chicago on Statutory Charge, By United Pre CHICAGO. July 20.—Lyman T. Yeargin, 64, publisher of the Oakland (111.) Ledger, in Soles County, was arrested in a hotel today and charged with a statutory offence on the complaint of Jule Smith, 17, of Terre Haute, Ind. Yeargin said he met Miss Smith on the train en route to Chicago Thursday. They registered at a hotel as father and daughter and were assigned to adjoining rooms, he said. Early today the girl came into his room and asked for money to buy a ticket to Peoria, 111.. Yeargin asserts. He declares he refused and Miss Smith returned to her room, locked the door between them and then locked the outside door to his room, making him a prisoner. House detectives found Miss Smith on a fire escape. They said she alleges Yeargin attempted to attack her.

Physicians at the Methodist Hospital tdday said the condition of Mrs. Claude Rhoades of Denver, Colo., injured in an automobile accident near Shelbyville Thursday was improved, Mrs. Rhoades’ arm was crushed. Mrs. Rhoades, her baby and her mother-in-law, Mrs. George Rhoades, were riding in the automobile when it turned over. Mrs. George Rhoades suffered minor injuries. The baby was not hurt.

LEADERS DISCUSS CONVENTION PLANS Tammany Hall Man, Illinois Leader, and Taggart Meet, By Time* Special FRENCH LICK, Ind , July 20. Following a conference Thursday between George E. Brennan. Illinois Democratic leader; Charles F. Murphy. New York, Tammany Hall head, and Thomas "Taggart, backers of Governor A. Smith, New York, felt some encouragement. Although' Taggart did not say the subject of a wet plank in the Democratic platform was brought up, some observers feel that Brennan broached the subject. Taggart said the meeting was for discussing plans for the Democratic national convention. Taggart's position was considered clear when, with Smith at French Lick, he declared there would be no wet candidate on either party ticket.
