Aberdeen, S D„ was shot death by Edmund Rust, alias Roy wames. a gunman, on a Great Northern train at Wolverton. Minn., late last night, according to word here today. Rust was being returned to Aberdeen, where he broke jail while being held for five robberies. He was recaptured at Grand Forks and was being transported by Fulker without handcuffs. Aa the train pulled into Wolverton, the prisoner seized a gun from Fulker’s belt, fired a shot Into the sheriff's body and leaped through a window. Two men were under arrest today following a fight at 766 H Virginia Ave. Charles 81uder, of the Virginia Ave. address, is charged with assault and battery with intent to kill. Ross Clark, 2940 Park Ave., is charged with assault and battery. Clark Is in the city hotfpital suffering from a stab wound In the shoulder. Mabel Smith, 507 S. Alabama St.. Is held ns a witness. Miss Smith was employed at the home of Mr. and Mrs. George Sluder. Charles, brother of George Sluder, is said by police to have attempted to force his nttentlons on Miss Smith. She telephoned Clark. When he asked Sluder to apologize he refused, police say, and the fight followed. Shooting Victim Recovering Mrs. Fred S. Beck, 1604 S. Meridian St., accidentally shot through the hip by her husband, Sunday night, was not believed to be seriously wounded. It was said today. Beck, city smoke inspector, took a revolver from the mantel, and remarked he would put the gun In the kitchen cabinet for fear his son would find It. It was accidentally discharged.

The old Midland Railroad, whose rust-streaked rails and weed-grown right-of-way weaves along l between Brazil and Muncle, will be eold In September by Charles Martindale, receiver, on orders of Judge Albert B. Anderson In Federal Court. The road never showed a profit. Since ’903 It has been owned and operated jointly by the Big Four and Pennsylvania Railroads. No passenger trains have run since February, 1922. POSSE KILLS NEGRO Shooting Occurred After All-Night Search and Ixmg Chase. By Times Special NEW ALBANY, Ind., July 2.—A coroner’s inquest was to be held today over the body of Edward Daugherty. negro, 25, who was shot by Charles Hammond during a chase by police and a posse of citizens. Daugherty was wanted in Mitchell for an alleged attack on Mrs. Mary lans. Daugherty had escaped from officials. He was shot after an all-night, hunt and a chase which covered four miles.
