FAULKNER PASSES PEACE PIPE TO ST. MIHIEUOER POST Long Controversy Arising From Speedway Bill Ends in Meeting, Pinal pages in history of the controversy between numerous local post commanders of the American Legion ind State officers were written at a meeting of the St. Mihiel-Loer post, at which Perry Faulkner, State commander, was principal speaker, Wednesday night. Faukner, at the time the Moorhead anti-Speedway bill was before the Legislature, urged passage of the bill, attributing his attitude to action of the previous State convention of the legion. The St. Mihiel-Loer Post was one of the leaders of opposition to the bill, and criticised Faulkner severely for his indorsement of the measure. Faulkner, in addressing members of the St. Mihiel-Loer post, together with commanders and representatives of several other posts, urged the Legion to present itself as a more unified body at the next State convention. He said no resolution should receive final action until it had been posted conspicuously at lest one day prior to being handed down. He said the Speedway resolution, as many others, received its support at a time of heated enthusiasm and did not have a fair share of consideration. He congratulated members of the legion for their fairness of opposition to the measure, when the organization seemed divided against itself, and lauded the lack of personal antagonism that characterized the fight. J. W. Ebaugh, commander of the St. Mihiel-Loer post, presided at the meeting.

ARRESTS ARE RESTRAINED Dance Hall Owners Given Temporary Order Against Police. Police Chief Herman F. Rikhoff and the members of the board of safety today were served with a temporary order restraining them v from arresting persons dancing on Sunday at the Riverside Park dance hall. The order, procured late Wednesday by George W. Sinclair and John B. Ballard, proprietors of the dance hall, will be in force until Sepfr. 4, when the two will be tried for allowing dancing on Sunday. U. S. Howard, who died Tuesday at the Government hospital at Marion, Ind., will be held at the home, 1425 Kentucky St., Friday at 8:30 a. m., followed by services at St. Catherine’s Church at 9 a. m. STATE WITNESSES TELLOFLASHING 'Whipping Boss’ Unmoved as Death Story Unfolds, By United Prres LAKE CITY, Fla., June 28 —Brutal beatings, alleged to have caused the death of Martin Tabert in a convict /amp, were described in detail today in the .trial of T. W. Higginbotham, accused of the youth’s murder. Higginbotham, “whipping boss” for the Putnam Lumber Company, sat with his wife and small son in the hot, stuffy, little courtroom and listened to the testimony, apparently unmoved. Graham Ward, a locomotive engineer, was the first witness today. He said he had seen floggings of Talbert by Higginobtham. Other witnesses said when Tabert asked to be excused from work because of illness Higginbotham forced him to lie face downward while he whipped him with a heavy strap. The number of lashes was estimated by various witnesses from forty to eightyseven.

POLICE DETAIN PLAINTIFF Detectives awaited word from Springfield, 111., today as to whether or not Charles M. Williams, 32, of 40H4 S. Alabama St., is wanted by police there. Asa witness in city court Wednesday in a slaffder suit in which he was the prosecuting witness against Lillian Minton, 65514 Virginia Ave., a worker at the Wheeler Rescue Mission, Williams admitted he is wanted in Springfield, police say. Miss Minton was discharged.

COUGHING SPELL FATAL Nathan Bernstein Is Survived By . Eleven Children. The funeral of Nathan Bernstein, 56, who died suddenly Wednesday night at his home, 2016 N Delaware St., was to be held at 2 p. m. today at the home, with burial in the Indianapolis Hebrew cemetery. Death was caused, it is believed, by an excessive coughing spell, to which Mr. Bernstein was subject. He had not been in ill health. Mr. Bernstein was owner of a furniture store at 554 S. Illinoi.’ St., where his eldest son was associated with him. He was born in Poland and had lived in Indianapol s forty-one years. The widow and eleven children survive.
