RUTHENBERG VOTE ASSURES RETRIAL 9 OF FOSTER CASE Communist Leader Found Guilty—Verdict Carries Heavy Sentence. By United Press ST. JOSEPH, Mich., May 3. —Conviction of Charles E. Ruthenberg, Cleveland, in the Michigan communist cases last night, assures a retrial of William Z. Foster, liberal labor leader. A jury found Ruthenberg guilty of violating the Michigan criminal syndicalist law by advocating overthrow of the United States Government by force. The verdict makes the defendant liable to a ten-year prison term, a $5,000 fine, or both. Judge White deferrerd sentence until June 4. O. L. Smith, assistant attorney general, issued a statement declaring “it is a righteous verdict by an allAmerican jury. “Had Ruthenberg, a draft evader and a war obstructer, gone free, after the evidence presented, it would have been a blot on the country.” Foster. Ruthenberg and several others were arrested in a raid on a communist convention at Bridgeman, Mich., by State and Federal operMuch literature of the communist party was seized. * The jury which tried Foster recently disagreed. Court Awards Girl to Foster Parent in Dramatic Case. By United Press CHICAGO, May 3.—Mrs. James Morris, real mother of Beatrice Nuttall, will continue her fight for the child’s custody. Superior Court Judge hi vid late yesterday awarded Beatrice to her foster mother. Mrs. James Nuttali, Waukegan, 111. Mrs. Morris plans to attack the adoption proceedings on grounds she did not consent to them when her illegitimate baby was taken from her. LETTERS LOCATE GIRL Local Miss Found in Columbus—Joe Wilbur Under Arrest. Letters found on Joe Wilbur, Columbus, Ind., furnished clew's that led lb the finding of Mattie Short, 17, pissing from home since Tuesday. Wilbur, who has been rooming at 215 N. Liberty St., is charged with contributing to delinquency. Miss Short is the daughter of John E. Short, 403 Hanson Ave. Motor Police Bemauer and Gooch say Wilbur admitted he sent Miss Short to Columbus. BULL DOG IS STOLEN Animal on Guard Duty in Auto Taken by Thieves. Thieves stole license plates, bateries and a bulldog from automobiles parked in various parts of the city, police were told today. C. W. Fegeman. 1856 N. Pennsylvania St., reported a Boston bull pup gone. Edgar G. Downey, 2632 Roosevelt Ave., reported license plates 458813 and his certificate of title stolen. Ed Hall, 1204 W.
