151ST INFANTRY ON RIFLE RANGE Guard Members Try for Marks at Camp Knox —152nd Arrives. Times Staff Correspondent CAMP KN'OX, Ky„ July 31.—Camp under canvas has been established at Muldraugh, the rifle range, by the members of the 151st Infantry for the remainder of this week. Instruction in rifle firing will mark tne first few days. The men then •will be gi ven opportunity to qualify for shooting ratings. Pistol and bayonet practice will be held. The 152nd Infantry arrived in camp yesterday. Its course of instruction will be the same as that of the 151st last week. Practice with their pieces for the artillery regiments began today. All night manuevers will be held one .night this week. NORTH SIDERS BUSY Will Offer Financial Inducement to Move Butler College. Financial assistance will be offered by north side residents as an inducement to trustees to bring Butler College to Fairview Park. Harry E. Calland, Edward Clark and R. S. Trent were named a committee to make the offer. The financial committee will meet with 150 volunteer assistants at Fortieth St. and Capitol Ave. Tuesday evening to discuss plans for raising money.

BICKNELL—For the first time since the strike, began last April, the Pennsylvania yards have been filled with empty coal cars. FRANKFORT Glen Cushman, former manager of the Delphi Independent Oil Company, has been released under $3,500 bond. He is charged with appropriating several thousand dollars of the company's money. ANDERSON—Madison County will be 100 years old on July 1, 1523, but residents will observe the centennial a. the county fa r here in August. F RANKFORT—When he stepped on a loose board and fell from the second to the first floor of the new hospital building here, Lutz Strong was rendered unconscious and severely and cut. ANDERSON—TotaI taxable valuation of Madison County is $82,937,915. according to County Auditor H. P. Hardie. MCNClE—Merger of the Bruner Coal Company, the Ellis Coal Company and Panabaker Company into the Consolidated Coal and Supply Company, has been announced, with capital of $200,000. HARTFORD CITI—An operation performed upon himself revealed to Dr. T. C. Dobbs a sewing machine needle embedded in the left side of his chest which had been causing him pain. MONTPELIER— John Burke. 81, Civil War veteran, died here of injuries rece.ved last spring in an automobile accident. DRESSING ACT FATAL Ralph Franks, Indiana Dental College Student, Drowns in Sylvan Lake. By United Press ROME CITY, Ind., July 31.—Ral/>h Franks, 22, a student at the Indiana Dental College, drowned in Sylvan Lake .after he stood up in a canoe and tried to take off his coat. His arms were still entangled in the coat sleeves when the body was found. Franks had been a member of the orchestra at Lisle's dancing pavilion. Proposed Zoning Ordinance Divides City Into Five Districts and Regulates Use
Following is a summary' of the proposed city plan ordinance drafted for presentation to the city council by the city plan commission: The entire city is divided into five classes of use districts: • 1. Dwelling house districts. 2. Apartment house districts. 3. Business districts. 4. First industrial districts. 5. Second industrial districts. Dwelling House Districts In the dwelling house districts, apartment houses, stores and industries are prohibited and no residence building may be erected for more than two families. The dwelling house districts are subdivided into three classes of area districts. In the first class 7,500 square feet of lot area is required for each family housed on the lot. The minimum width of the lot for a single family house is fifty feet. In order to secure the required 7,500 square feet of area, j a depth of 150 feet will be necessary for a lot having this minimum width of fifty feet. Only areas where single family houses are now located on large lots or where vacant lots are platted with a minimum area of 7,500 square feet, have been placed in this firstclass area district. The second class area district requires 4,800 square feet of lot area per family and the minimum lot width is forty feet. A lot 40 feet by 120 feet is the minimum size for a single family house. The less I developed sections encircling the city have in general been placed in this district providing for a single family’ detached house development on fortyfoot lots. Most of the present dwelling house sections are, however, placed in the third class, permitting the erection of a house for two families on a 40 foot lot. Apartment House Districts In the apartment house districts business and industry are prohibited, but all kinds of residence buildings are permitted. The apartment house I districts include the areas not assigned ! to business or industry near the heart 1 of the city. The apartment house districts are I also divided into three classes of area ■ districts; the first requiring 1,200 ! square feet of lot area per family, j thus permitting four families on the ordinary forty-foot lot; the second j requiring 600 square feet of lot area per family, thus permitting eight families on the ordinary forty-foot j lot, and the third, designed for the j elevator apartment or hotel, building, • having no restrictions as to the number of families that may be housed on a given lot area. Building Lines Building lines are established in all dwelling house and apartment house districts. Where 50 per cent of the frontage in a block is built up with buildings that set back from the street! line the alignment of the existing buildings is made the building line. No new building is permitted to project bey’ond the front of the adjacent j buildings. In blocks that are not sufficiently built up to form existing alignment lines, a building line is fixed at 20 per cent of the average or normal depth of the lots in the block If, however, the lots are more than 200 feet in depth the set-back from the street line need not be greater

than forty feet. Along the side line of a corner lot the set-back must be 10 per cent of the width of the lot up to a maximum of ten feet. Side and Roar Yards In a dwelling house district or apartment house district, side yards are required, having a minimum width of four feet, and at least 20 per cent of the width of each interior lot must be devoted to side yards, provided not more than sixteen feet need be so devoted. For an apartment house or for any building more than two and one-half stories in height, the width of each side yard shall be not less than one-sixth of the relght of the building. In a dwelling house district the rear yard shall be 15 per cent of the depth of the lot, but need not ex ceed thirty feet. In an apartment house district the rear yard shall be not less than one-half of the height of the building.. Forty per cent of the area of the rear yard may be occu pied by a one-story garage or other necessary building. Business Districts In a business district, the ordinary uses found in the central business section and in the local neighborhood business centers. Including the public garage and various storage uses, are permitted. In the central business section very light manufacturing, jot printing and newspaper printing arc also permitted. Any buildings or uses permitted in the dwelling house districts are also permitted in the busiiness districts. A large expansion of the central business section is provid ed for. Small local business centers are provided at approximately half-mile Inter vals throughout the residence sections except where a scattering of stores along a street car route has made it advisable to throw the entire street Into a business district. Industrial Districts The two classes of industrial districts include substantially all of the areas now devoted to Industrial purposes and provide for large areas for industrial expansion along the various railway routes and adjacent to the central business section. The distinction between the first Industrial district and the second Industrial district is that certain semi-nulßance Industrial processes that are permitted in the second industrial district are excluded from the first Industrial district. These uses, for which the second industrial district is especially designed, are certain chemical plants, gas plants, central station light or power plants, boiler making, structural Iron works, packing houses, glue manufacture, fertilizer manufacture, etc. The following uses are entirely prohibited within the present city limits: Petroleum refining, cement, lime, gypsum or plaster of paris manufacture, chlorine or hydrochloric, nitric, picric or sulphuric acid manufacture, smelting of copper, tin, zinc or iron ores, and the manufacture or storage of explosives. In the 80-foot, 108-foot and 160-foot districts, howexer, the limit fixed is merely a limit at the property line, and after reaching such height, buildings may go higher if set back one foot for each three feet of additional height. This set-back must be from the side and rear lines of the lot as well as from the street line. It is also provided that the board of zoning appeals may permit a tower covering not more than 25 per cent of the area of the lot to be erected to any height. 150-Foot Height Limit The 150-foot height limit applies to the central business suction with the exception of the frontage around the Circle and along the Plaza. The 108foot height limit applies to the Circle, the frontage along the Plaza and to the commercial, Industrial and elevator apartment house sections adjacent to the central business dlstrlot. The 80-foot height limit applies to industrial areas outside of the central section. It Is provided, however, that grain elevators, gas holders and other industrial buildings requiring a greater height for the normal operation of the industry may be erected to such greater height, with the approval of the board of zoning appeals. existing uses of property. A use or building existing at the time of the passage of the zoning ordinance which does not comply with the regulations of the district in which It is located Is called a non-conforming use. Such uses and buildings may be continued. The zoning ordinance is not retroactive. If, for example, there Is a store. In a block that under the zoning ordinance is Included In a dwelling house district, the store may, nevertheless, be continued. A buUding housing a non-conforming use may not, however, be structurally altered to an extent exceeding during any 10-year period 60 per cent of the assessed value of the building. Enforcement Board of Zoning Appeals The zoning ordinance will be enforced by the commissioner of buildings. No building permit will be Issued unless the building and its proposed use conform to the zoning regulations. In the application of the zoning ordinance many cases will arise, especially near the dividing line between two use districts, where the strict letter of the zoning regulations may properly be modified. This can be done in specific cases without injury to the general public purpose of the ordinance, while at the same time avoiding unnecessary injury to the individual owner, Strictly limited discretion is therefore lodged In a board of zoning appeals created by j
the ordinance to make minor modifications and exceptions to the general rules and regulations established by the ordinance. Amendment of Zoning Plan Subsequent to the adoption of the zoning .ordinance the council Will have full power to amend find supplement the plan from time to time.
