SMALL NOT TO HAVE HEARING IMMEDIATELY Delay of Month Likely Before Illinois Governor Faces Trial. ONE CHARGE DROPPED WAUKEGAN, in.. Dee. 30— Prospects of an early trial of Governor Len Small, on charges of conspiracy to defraud the State, appeared somewhat remote today and Indications were that at least a month might elapse before the case is brought before a jury. A bill of particulars is to be given the defense by the State on Jan. 5. and the defense will nave its motions with reference to this bill ready for presentation In court on Jan. 7. It Is expected arguments and rulings on these motions will require several days. It Is expected the defense also will present motions for a separate trial for Governor Small and Vernon Curtis, Grant Park banker, who also is involved In the proceedings In Circuit Court here. EARLY TRIAL UNLIKELY. It is practically certain the case will not go to trial on Jan. 9. gs had been planned by Judge Claire C. Edwards. • Both sides were claiming victory as a result of the sen sat! na’ developments of yesterday when the State. late in the day, dismissed the charges of embezzlement of $500,000 of State interest funds against Governor Small alone. Earlier Judge Edhad upheld this indictment, but *id quashed an indictment charging Governor Small, Curtis and Lieutenant Governor Fred E. Sterling with embezzlement, end had quashed several counts of the indictr.' r.‘ charging conspiracy. Whr-n Judge Edwards and attorneys fi r the defense insisted Governor Small should first b 'Tied on the embezzlement charges, State's Attorney Mortimer of Sangamon County, moved the dismissal of the embezzlement indictment. His motion was granted. Governor Small, in a statement issued after the proceedings, expressed regret that the embezzlement charges had been dismissed, declaring h.e felt certain a trial before a jury would haTe resulted in a degree of vindication not carried by the dismissal of the charges. SAYS, STATE IS RItADY. State's Attorney Mortimer, after admitting the State had lost a ‘ technical point or two,” maintained the guilt or innocence of the defendant had not been settled and declared the readiness of the State to present its evidence. As the case now stands. Governor Small and Curtis must go to trial on nln* counts of an indictment chargi- g the*, two and Sterling with conspiracy to defraud the State of |2.000.C<0 In" interest funds. Each of the nine counts Is similar in nature. The charges amount to a.<|elaration that the three conspired to turn over to the Grand Park hank, which the State charges was a ‘‘pretended and fictitious bank.” SIO,C<OO/nn In Sta'e funds. Only a small portion of the Interest on this suiu. the indictment charges, was returned to the State. Sterling is not Involved n the trial in r ho •'•our - 1 - .gr • of venfcn fr s- _ n were first returned.\ Judge Edward- rulings on the indictments, however, arheld to apply to Sterling's case.

GROTTO HOLDS MOCK WEDDING Synthetic Ceremony Resembles Genuine Marriage. A blushing “bride” entered the second right box at English's Opera House last night, just before the curtain rose on the Mitzi show. The “bride,” dressed In wedding togs, including a long veil, wedding bouquet, white gown and the like, entered the box accompanied by the groom. Little Miss Millleent Coleman and Iris Myers were the flower and ring bearers, respectively. Members of Sahara Grotto, who had taken over the house for the order and its friends v greeted the couple. At the close of the first aet, a “minister” performed the wedding ceremony from a box. The ceremony was carried out with all the dignity of a real wedding and many got the impression that Charles Gaunt was actually being married. Just before the final curtain, the “bride” removed her veil and it was discovered that the blushing and lovely creature was a man.
