BETILIN, Oct. 11.—“ We stand or fall Ly undivided Upper Silesia.” With this solemn pledge a dozen gravefaced German statesmen —members of the German government —shook hands and then left the chancellory building early today, after a conference that had lasted nearly all night. The conference dealt with the reported decision of the League of Nations to reject Germany’s claims In Upper Silesia. It was admitted by the minister “they could not tell whether they would stll. be members of the republic’s cabinet twenty-fonr hours hence.” The extraordinary ministerial council came as a climax to a series of feverish under-current developments revolving about the Upper Silesian situation. It had been reported from Geneva that the League of Nations’ decision on the rival German-Polish claims in Upper Silesia would not be handed down until Thursday, but the activity on the part of the German government led to the belief the decision already is known here. JOHNSON THEFT TRIAL CARRIED OVER TO OCT. 13 Case Continued Because Francis, Chief Witness, Is Absent. Over the protest of his attorney, the case of Fred (Doggie) Johnson was continued In city court yesterday until Oct. 13. It is alleged by the police that Johnson was one of the men who stole an automobile belonging to Harry E. Yockey, assistant city attorney, while he was seeking the Republican nomination for city judga last spring, This allegation is based on the strength of the confession of Frank Francis, the Louisville "talkative burglar.” Ira Holmes. Johnson's lawyer, told the court: “It Is positively absurd to hold Johnson on a charge for which three other men are now serving time. These men led the police to the stolen car and confessed to Its theft and yet they hold Johnaon on a charge of burglary and grand larceny.” Holmes also is the attorney for J. Herbert Hartman, candidate for city Judga on the Republican ticket, who was involved in Francis' confession. The continuance was granted becanse of the fact that Francis, who was to be the chief witness, was not present. Holmes told Henry Abrams, Judge pro. tem., that it was his firm belief that “the police department of Indianapolis Is doing everything in its power to keep Francis out of its jurisdiction.” Judge Abrams assured Holmes that if the State bad not secured Francis as a witness or was not ready to present its case on the fifteenth of the month, the charges would be dismissed. lie explained his action In granting the continuance on the request of the State by saying that he was doing this as a duty to the people of the county and State.
