With a Jury in the city court finding Westley Baldwin, a driver for the Quill Trucking Company, guilty of a charge of failing to display a State automobile truck license and imposing a fine of sls and costs, City Judge Walter Pritchard takes the same view of tho validity of the automobile license statute as that entertained by Judge T. J. Moll of Superior Court, Room 5. Baldwin was tried by a Jury, late yesterday which rendered its, decision after one hour of deliberation. His case was one of a hundred and fifty which are pending on the docket for the same offense. Baldwin immediately filed notice of an appeal to the Marion County Criminal Court. Judge Pritchard fixed the bond at SOS. Counsel for the drivers of the various trucking companies who are slated for trial on charges of falling to display a State automobile license, failed in thur attempt to delay the hearing of all such cases in the city court until the Indiana State Supreme Court passed upon the ruling of Judge T. J. Moll in the case of W. S. Frye, local transfer man. Judge Moll in this case upheld thi validity of the 1010 and the 1921 motor vehicle statutes with their amendment* and the court refused to grant an injunction restraining State, city and county officials from enforcing the provisions of the statute providing for the payment of a license fee. Mr. Frye after asking for anew trial, which was refused by Judge Moll, served notice of appeal to the In- i diana State Supreme Court. Prosecutor William P. Evans in the city court refused to tolerate any delay and insisted that all cases be tried. Sept. 22 Limitation of the commissioned personnel of the Armv to its present strength, approximately ll.OOd instead of the 14.000 authorized by law is being considered by the central staff and John W. ; Weeks, Secretary of War, both on the theory that the existing number is sufficient for the size of the Army and to reduce the cost of the Army. -• The plan which has been worked out by the general staff but which has not been definitely approved by Mr. Weeks provide? that all further vacancies at the bottom of the list shall be filled from West Point and frr.m selected men ’ from the ranks only. It further provides that vacancies in the higher grades shall be filled by promotion only. Adoption of the plan would moan eventually a gradual decrease in the number of officers. The rate of resignation and death is higher at this time than the number of graduations from the ■ Military Academy. Secretary Weeks had this policy in mind when the most recent examinations were held for appointment to the Army from civil life. At his direction the test was made very stringent, 6o that only the few best men of the applicants would receive commissions. DIPHTHERIA IN CITYINCREASES Diphtheria easel reported to tho board of public health reached the highest total for September during the first twentvone days of this month since 1917. Eleven r- porled within a few h.>’>rs Wednesday brought the total for this month to ninety-three, with five deaths, health department records show. During September of last year there were twentyone cases, with one death. In the same month of 1917 there were 23S cases and sixteen deaths. The cases reported have increased rapidly since the opcin" • f ho-.l n-r. tieularly on the south side and in West Indianapolis, Dr. Herman G. Morgan, secretary of the board of public health, stated. School physicians and nurses are being specially assigned to districts where the heaviest number of cases are reported. The doctors have instructions to vaccinate all children whose parents give consent and the health department is urging all parents to take the step as the most effective means of checking the spread of the disease. The health department laboratory will furnish free of charge vaccine for the immunization of children whose parents are unable to pay for It, Dr. Morgan said.
