GOVERNMENT VICTOR IN U. S. COURT FIGHT Validity of Indictments in Leak Case Upheld by Justice Sid dons. FOUR MEN FACE TRIAL WASHINGTON, June 17. The government won a notable victory today in its long fight to protect the inviolability of the United Sates Supreme Court decisions. The decisions of the Nation’s highest tribunal, embracing as they do the “great issues of life, liberty and property’’ are of vital concern to the welfare of the Nation and they must not be dragged into the mire of stock market speculation through connivance and conspiracy, accord, ing to a decision handed down today by Justice Siddons, in the District Supreme Court. Th* decision ot the court was rendered in dismissing the demurrers that had been filed to the Indictments of Ashton F. Embry, former private secretary to Associate Justice McKenna and his three associates, E. Milard Mayer, J. Harwood Graves and B. E. Moses. They were indicted for surreptitiously obtaining advance information on important decisions and using the information thus obtained in stock market speculation. Their activities were first disclosed by an expose of their system by Marlen E. Pew, editor and general manager of the International News Service, after weeks of investigation. On Information furnished by Mr. Pew, the Government indicted them for conspiracy to defraud the Government, and Justice Siddons’ decision today upheld the validity of that indictment. The decision assures that the four men will have to stand trial on the indictments.

The most Important places on the ticket which voters will find under, the Republican emblem can evoke no pride in good Republican citizens nor command their allegiance. The ticket is not representative of the party. The issue is the welfare of the industry, of the business, of the homes, of all of the decent concerns of the people of the city. ’Mr. Shank was once, at a time easily within the memory of its people, elected mayor of the city. He was a failure in >ll of the essentials of the office. All of the particulars of that failure cannot be reviewed in thts appeal. They will become fresh In the minds of the people before election day. But a primary duty of the city government and of the mayor charged with executing it is the duty of checking and supressing vice and crime, ■maintaining order, preserving peace and protecting persons und property a* the laws havo provided. Under Mr. Shank s administration, encouraged either by Ms •ympathy or weakness, vice and crime were .prevalent, gambling was protected and flourished and finally public order was overthrown by riot, mob rule and violence which menaced the lives of the people of the city and their property. At •ucn a crisis Mr. Shank himself, by his ord-rs. prevented the police force from performing its high duty under the law to preserve order and protect persons and property. So menacing did conditions become and so oat of control did they grow that Mr. Shack resigned from bis office with an acknowledgement that he was not competent to deal with the situation which his weakness had larger created. With him again mayor can industries and business now with us look with hope upon the future in their effort to survive and revive from tbo present difficult conditions? With him again mayor can we hope that new Industrie*, row looking to our city as a favorable location, will come? Can wage earneri hope for work and wages with confidence from timid and unprotected employers without the protection of the law t vuth rambling and Tice promoters, and with bootleggers among his chief supporters end contributors to his campaign fund can the people hope from him a moral and orderly government? By his official acts and personal conduct he brought to th© city a certain noteriety that no good citizen took pride In. gHANK FITCRE GOVERNED BY PAST THEY SAY. ‘‘The people of Indianapolis cannot expect better from Mr. Shank in the future than in the past—but worse—for he is now in alliance with, and supported by, the conscienceless, tax extortionate and utterly wasteful crew now in charge of the government of Marion County. It is not possible now to detail the misgovernment of the Shank-Tutewilor board cf countv commissioners. Itß maladministration in many particulars is fresh in the minds of the people. But it is fair to point to the latest lawless exploit of the Shank-Tutewiler-Fesler combination in wantonly, and utterly without authoritv of law, destroying a governmental unit of the county—Pike Township—that they might bring the school! of the county within the malign power of their organization. And while we realize that a rapidly growing citv increasingly enlarges governmental burdens, yet we assert that taxes are too high.
