John Matan, 29, 559 West Washington street was fined SIOO and costs and sentenced to serve forty days on the Indiana State Farm; Edward McCloud, 45, 536 Smith Lane, was slued SIOO and costs and sentenced to thirty days, and Harry Tarbell, 30, 823 North Liberty street, was fined S3O and costs and sentenced to ten days in Jail on charges of operating a blind ti,ger by Judge Walter Pritchard in city court today. The light sentence given Tarbell was “due to sickness of his wife and < ’lildren,” the Judge said. The three men were arrested May 10, by Lieutenant Winkler, Federal Officers Abel and Thomas, In a house at 20->7 Yandes street. The officers said they had been following the machine Matan was driving the greater part of the day. They said they saw one of the men in the machine sell a pint of “white mule” to a negro but were unable to catch either on account of both having highpowered machines. NEW BERNAUER VENIRE IS DRAWN Second Trial Opens Tuesday at Shelbyville. Special to The Times. SHELBYVILLE, Ind., May 13.—Preparations have b#en completed for the second trial of Carl Bernauer of Indianapolis, who is charged with murder in the first degree, with the drawing of fifty names from the jury box of the Shelby Circuit Court for the special enire in the - case which is set down to begin next Tuesday morning, following the opening of the May term of court on Monday. It is expected that the trial will takp Tip all of the opening week of court, Bernauer will be represented by Ira Holmes, of Indianapolis, and Henry and McLane of this city, who were his attorneys in his first trial, which resulted in a hung Jury. Prosecutor Evans of Marion County will be assisted by Prosecutor Elmer Bassett of Ehclby County for the State. Bernauer is one of the two prisoners in the Shelby County Jail. He has been confined here since the early part of February when his case was veuued her® from Marion County.
