1 DEAD, 4 HURT IN GUN BATTLE Citizens Fire on Chicago Police While Being Questioned. CHICAGO, April S. —One man was killed and four wounded in a gun battle in South Chicago early today in which two policemen and three citiz ns participated. At least one of the wounded may die. 1 , George Nlkslch, shot in the neck, died at a hospital soon after the shooting. Ilis brother, Robert, was shot in the head and leg and Joseph Fetich, brother-in-law of the Niksichs, Is in a serious condition with a bullet in bis left lung. John Tracey, detective sergeant, was shot in the abdomen and physicians say he has only a slight chance of recovery. Policeman John E. White was shot lu the right hand. The shooting followed, according 'to Policeman White, an attempt by the officers to halt the three men for questioning. When asked to halt, White said, the three men opened fire without j warning. Police authorities began an lnvestlg* tion today. ‘HILL BILLIES’ RUN LABORITES Arkansas Town, Incensed Over Strike, Routs Leaders. JOPLIN, Mo., April B.—Driven from Arkansas by Irate citizens at Harrison, who resent the strike tie-up of the Missouri & North Arkansas Railway, only connection with the outer world, six union rail leaders, have wired an appeal to brotherhood executives for Federal probiction. Forced out of Ilarrison. M. C. Carey of Port Huron, president of the Railway Conductors, and L. M. Eddy of San Francisco, representing the order of railroad telegraphers, came here. Carey said these three brotherhood men, also driven from Harrison, were on their way home: J. L. Saxe. Ft. Worth; W. J. Potts and W. E. Hoarn, Little Rock.

Court Uses 2 Juries at Shelbyville Special to The Times. SHELBYVILLE, Ind., April B.—The practice of having two juries in service at the same time in the Shelby Circuit Court was repeated yesterday when a Jury was Impaneled for the hearing of the complaint of J. J. Totten A Son against the American Railway Express Company, while deliberations were being carried out in an adjoining room by the Jury which heard the evidence in the complaint of Roy McDaniel and James McVay against Jake Schott, The latter Jury reported to the court at noon that It had failed to reach an agreement after haring been out since 4 o'clock Wednesday evening and was dismissed by Judge Alonzo Blair. The complaint was for damages which the plaintiffs demanded as the result of alleged diseased cattle , sold them by the defendant. Damages of $250 are a<ked as Judgment In the suit of Totten against the American Railway Express Company for , the alleged loss of a horse in shipment •from Milwaukee to Fairland, Jnd., the _ plaintiff charging that owing to the neg- , ligence of the defendant the horsecar was ‘ permitted to remain open and one of the r horses stolen. Sheriff Braden located Clark In company with Mr. Hessler endeavoring to 'obtain an abstract for the farm. Straw Vote Shows Trend of Opinion Special to The Times. LOGAXSrORT. Ind., April B.—A straw rote conducted here on the city managerial form of government, reveals an overwhelming majority In favor of the new form. The results of the vote show a total of 401 ballots cast in favor of the business government, while only 82 Totes were against it. Petitions are being circulated about the city to bring about a referendum vote to decide whether or not the plan will be accepted or rejected In this city. BJIELBYVILLE PASTOR RESIGNS. SHELBYVILLE, Ind., April 8.—R,%. Fred R. Barnaby, who has been pastor of the Waldron Baptist Chun h for more than a year, has given his resignation to the membership of the church nnd 'will devote his time to other work. Rev. Barnaby succeeded Rev. Fred Y'oung. now pastor at Westport, and was formerly the pastor of the Burney Baptist Church. Under his leadership, the Waldron church hag increased materially in membership and had a very successful year.

WILLIAMS NOT TO PASS ON PERMITS Regulations Said to Fix Two Bottles a Day Limit. WASHINGTON, April B.—Tentative regulations for the prescribing of beer and wines by physicians, which have teen drawn by Prohibition Commissioner Kramer’s legal staff, will not be approved by Revenue Commissioner Williams, he stated today. Commissioner Williams said hs would consider the regulations, which are understood to limit beer prescriptions to two bottles a day, but that approval would be left to the new commissioner.

Grant. 65, has sued to quiet title to the r;al estate she gave him, and in which she retained but a life estate. She alleges that he has cursed her and brought rough companions to her home who drank and cursed, and that he has threatened her life with a revolver.

FARMERS JOIN TO MARKET GRAIN Cooperative Agency Represents 23 States. CHICAGO, April B.—The first cooperative agency for the marketing of the Nation's grain crop has been definitely launched today with the adoption by delegates from twenty-three States of a report by the committee of seventeen recommending the establishment of a ’’armers’ grain marketing organization. Thq. organization is to be known as the United States Grain Growers, Inc. All farmers who pay an annual fee of $lO each will have the optional right of marketing their crops through the cooperative organization. At the end of the year a balance will be struck and all funds not needed for expenses will be returned to the farmers, pro rata. The organization proposes to build Us own elevators and terminal warehouses and will establish Its own market news service. A general headquarters will be maintained with branches at central points throughout the grain growing districts. A board of twenty-one directors will be chosen later to conduct the organization's affairs. Amendments to the plan which would have provided for compulsory pooling of corn and wheat were voted • down after a spirited debate and the report of the committee of seventeen, composed of representatives of various farmers’ organizations, was adopted unanimously. Grain exchanges and boards of trade were bitterly attacked by several delegates.

Commission Form Friends Organize Special to The Times. MARION, Ind.. April 8. —At a meeting of Interested citizens held Wednesday evening it was voted unanimously to organize a citizens’ league here to work for the adoption of the commission-man-ager form of government in the city of Marion. Miss Bessie Case, Turner Overman, Walter B. Stephenson, Fred Eward and Earl Mason were appointed to nominate an executive committee for the league. The committee will be composed of fifteen men and women who are In favor of the commission-manager plan. C. It. THIEF ESCAPES COP’S BULLETS Drops Suitcases and Runs When Policeman Shoots. A thief who had broken into Jacob Taverowitz's store, 1257 Oliver avenue, early today, dropped two suitcases con- [ tainlng the loot stolen from the store j and ran when Patrolman "Wilson opened fire on him as he failed to obej' the officer’s command to stop. Wilson siw the man turn to enter an alley on Warren aVenue near Oliver avenue and ordered him to stop. The man started to run and the policeman fired. The thief dropped the suitcases In order to facilitate his escape. In one of the big cases there were forty shirts and in the other there were fifty-five pairs of shoes. Later it was learned that the shirts, shoes and suitcases had been stolen from Taverowitz’s store, and that the glass in the rear door of the store was broken by the burglar. Policeman Wilson later arrested a man giving his name as Wesley Martin, on a charge of vagrancy. He is being questioned by detectives. Naming of Hoosier Coadjutor Ratified Special to The Times. SOUTn BEND, Ind., April B.—" Word was received by authorities of Notre Dame University from Rome that the Pope had approved of the appointment of the Rev. J. H. Morrissey, provincial of the Holy Cross order in the United States ns coadjutor with the right of succession to the superior general, the Rev. Gilbert Francis. The Rev. Ft* Morrissey will leave shortly for Rome to visit the Vatican and houses of the congregation in Italy and France. For many years the Rev. Fr. Morrissey has been affiliated with the work of Notre Dame University and was formerly president of the institution.

Fine Country Home Destroyed by Fire Special to Th® Times. LOGANSPORT, Ind., April B.—The country home of Mrs. Effle Shelton, six miles north of this city, was destroyed by fire last night.
