‘PAPER’ RAILWAY DEAL PUT OVER UNDER M’CRAY (Continued From Page One.) battle against McCray and others to recover for his time and expenses. It discloses that Taylor conceived the •idea of building a railroad from Terte Haute to West Lebanon, there to connect with existing lines and a company known as the Covington & Southern railroad was organized on June 28, 1899. On Sept. 5, 1000, this company changed its name to the Chicago, Covington A Southern railroad and changed the northern terminus to Hammond. The proposed line was then to run about two miles away from Kentland. W. T. McCKAY INFLCEXCED ROUTE In March. 1901, McCray, Carrol C. Kent. Will Darroch and Harry Strohin met Taylor in Chicago and requested him to change the route of the projected road to include Kentland. This was about the time an election

was being held in Newton County to decide on the removal of the county seat from Kentland to Goodliind and these gentlemen were much Interested In retaining v he county scat. In May of 1902 McCray employed Taylor to make a pretense of locating this railroad through Kentland and It is an interesting sidelight that the evidence discloses that an agent of McCray caused Taylor to change the -line once because It was coming into Kentland on a line that would take It “through McCray’s residence.” Later on, the. evidence discloses, McCray caused a paper corporation known as the Chicago, Terre Haute & Southern Railroad to be formed with a set of “dummy directors” whom McCray testified be controlled. The purpose of this, McCray testified, wa6 to have an “unencumbered” company which would not be bound by the debts of the company that Taylor controlled. A contract was entered into between McCray, Kent and Taylor by the terms of which they were to share alike in the proceeds of promoting the proposed railroad. Taylor caused the Chicago, Covington !

& Southern railroad to transfer its assets to the Chicago, Terre Haute and Southern company in accordance with this contract and this McCray tompany made a contract with the Indiana Harbor company to build the proposed railroad. The Indiana Harbor company did not build and Taylor urged in vain that the company which McCray now controlled bring suit to enforce the contract. Later the Indiana Harbor Railroad Company, allied with the New York Central lines, constructed a railroad along approximately the same route that Taylor had originally planned. By this time Taylor, whose Interest in the project had been effectually wiped out through the manipulations of the various companies, had concluded that he wns being gently and gradually relieved of what he regarded as valuable property. He was pushing McCray to collect and McCray was asserting that Taylor, McCray and Kent had no lei*ul rights and could not collect anything out of the project, (although he Insisted he was trying to get recognition of the claim from , the New York Central lines. Kventunlly Taylor brought suit against |the Chicago, Indiana &. Southern Railway
Company, McCray and Kent, the theory j being that the Chicago, Indiana A Southern Company was representative of the New York Central Interests, which had built the railroad, and McCray and Kent, by reason of their unwillingness to compel the Indiana Harbor Company to live up to its contract to build the railroad, had helped deprive Taylor of one-third interest in property which, he valued at SIBO,OOO.
