The following laconic apology, by an editor in Ohio, may be of some use to the faculty, should they at any time be under the necessity of informing their incensed patrols, that for want of ink or paper, (or other good reasons) they have been unable to give them a paper for the last tivo or three rcecks. It appears that the United States' forces at Key West, have had to grapple with a more formidable enemy than the furious desperados who infest the West India Islands. A gentleman who lately arrived at Charleston from Key West, states that the yellow fever was raging at that place with alarming mortality. Out of 30 marines, and from 30 to 40 sailors, who were left at this Island by Com. Warrington, there were, when the informant departed, but three marines and free or six sailors able to perform duty; two thirds of them having died, and the remainder lying very ill. From the foregoing account, it would seem that the West India

ed in suppressing the horrid depredations of the lawless buccannecrs, is falling a voluntary victim to a pestilence more fatal than the sword.

Com, Porter. The Court Martial which has so long been engaged in investigating the conduct of Com. Porter, has at length reported, that he was found guilty of each of the charges and specifications preferred against him, and have sentenced him to a suspension for six months. Thus has this gallant officer, this pride of the Navy, this intrepid defender of our country, whose brilliant services will ever be remembered with gratitude, and whose name will ever be revered by the American nation, been sacrificed to the ambition and jealousy of Samuel L. Southard and others, for having justly chastised the insolence of a piratical band, and for resenting, with moderation, an insult

offered to his country in the person of one of

its officers. We will not, however, attempt to adjudicate on the matter; but we will venture to premise this much, that, although

ries with him the best wishes and decided approbation of a majority of his fellow citizens.

the power of electing from their ozen body a president pro tern., in case that office should be vacated by death, resignation, or otherwise, who holds his appointment until a lieutenant governor is inducted into office, or until an appointment is again made by the Senate, which is always the case immediately on its convention, should there be no lieutenant governor. The very fact of the Senate going into this election, at the commencement of each session, presumes a vacancy in that office. Now comes the question, When does this vacancy occur? Would it not be rational to suppose that it occured at or previous to the annual election? We are disposed to think it would. At each annual election one third of the members that compose the Senate are elected, who hold their office for three vears from and after the first Monday in August; at the expiration of which time no one is entitled to a seat unless re-elected. Now we connot see how a man can exercise the functions of president of the Senate, unless he is a member of that body, for that is the very condition on which the office is held. If the Senate should be convened at any time before the first of December, would Mr. Ray be eligible to the

Ray to exercise the functions of governor, by

virtue of his election as president pro tern

of the Senate, until the constitutional time

arrives for his qualification as governor elect;

on the other side it is as stronlv contended

that he has no right by the constitution, or by virtue of his election as president pro tern, of the Senate, to act as governor; for, say they, the Senate, by whose authority he

exercises the functions of governor, does not

now exist, and therefore all officers by it cre

ated or appointed also cease to be. Here

is the pivot on which the question rests. If

the Senate can, constitutionally, elect one

of their own body to an office which shal

continue after it ceases to have authority as a

body, the president pro tern, is to all intents

and purposes governor, and can exercise

authority as such until a governor is electee

and qualified ; but if, on the contrary, the

officers of that body cease to be such at the

end of each elective year, (as we conceive,)

then the exercise of anv power, by virtue

of these appointments, is illegal.
