FRIDAY, APRIL 26,2002

SYSTEM Rep. Carson receives 2 awards

Continued from A1 witness protection? Wilcoxson: How can you send a witness out of town, and pay for it, and get a taperecorded statement, but not a deposition? How do you tell the parents of a murdered child that you could not get all the attorneys together for a deposition? Why wasn’t she locked up when they found out she was slipping back into town, so that no harm would come to her? The second time I asked Prosecutor Brian Poindexter why he didn’t get a deposition, I was told it was because he didn’t feel the need, since she had been sent out of town. What kind of answer is that? Something is definitely wrong with this picture. Recorder: It was determined that foul play was not connected with her death. Wilcoxson: Sure, no causes were detected, but her death was really mysterious. When she was found, her body was covered up. Recorder: What is your overall opinion of the justice system? Wilcoxson: It seems to me that the system is more concerned with putting away drug dealers who are not murderers, that it is allowing murderers to get away free? Either they are smarter than the drug dealers, or much more brilliant than those in control of the justice system. Recorder: Is there anyone who you feel did their job well? Wilcoxson: The only person who showed great concern for this case was Detective Martinez. He is as hurt as I am about the way things have gone. Indeed the books on this case have not been closed, according to Deputy Prosecutor Ralph Staples. “We had no choice but to release them (the three suspects in the case),” said Staples. “The trial date was coming up, and if we had gone to court we would have lost, because of insufficient evidence.” When asked about Wilcoxson’s charges about the death of Williams, Staples said, “At that point and time, we had no evidence that pointed to an unnatural death. There were no marks on her body, or any poison or drugs found in her system that would cause an unnatural death. “The only reason we would take a deposition is if a witness we planned on calling in our case was going to be out of the country, unavailable, or was near death, because it is the right of the accused to have their attorney to confront the witness. This is called ‘the right of confrontation.’” Staples did say that because the suspects were released, this gives prosecutors an opportunity to rearrest and bring them to trial if sufficient evidence is produced. Martinez said he believes the right suspects were in custody. “I feel that these guys were definitely involved in this,” he said. “Unfortunately, the main piece of evidence I had passed away, and that would be Chawntell Williams. But this case is not closed just because the charges have been dismissed. If I develop anything more in this case, testimonies of witnesses, or physical evidence, charges will be filed again.” In conclusion, Wilcoxson said she wants justice. “1 have had too many sleepless nights, and his father has had them too. I have cried so many tears. So many times I have visualized Tory being duct taped and shot, and that picture just tears my heart apart, and it’s bleeding.”
