The federal government had sued the church in an effort to collect $3.5 million in employment taxes for 1987 through 1993. With penalties and interest, the tax bill has grown to approximately $6 million. U.S. District Judge Sarah Evans Barker in Indianapolis ruled against the church, and the 7th U.S. Circuit Court of Appeals agreed last August, saying the church “must comply with the federal employment tax laws.” In the appeal acted on Tuesday, the church’s lawyers cited the Constitution’s protection of the free exercise of religion and said the Indianapolis church’s doctrine cannot be compared with those of other churches. “The power to tax the (Indianapolis church) in effect controls and suppresses the exercise of the faith and practices of the church,” the church’s lawyers said. The permit is scheduled for review by the Board of Public Works, which King said will follow his recommendation to deny. If the Klan marches in Gary on Saturday, King said Klan members will be arrested. Within hours of King’s announcement, Klan members contacted members of the Indiana Civil Liberties Union and asked for the group’s help. Kenneth Falk, the ICLU’s legal director, said that if the city does not allow the rally, the group will file a lawsuit seeking an injunction.
