The insurrection charge has been ruled unconstitutional twice; once in 1937 by the United States Supreme Court and in 1963 by the three-judge panel that set Harris and his co-workers free. Harris and Wells are charged with “attempting to incite insurrection” and “circulating insurrectionary matter.” A Third Negro, Nick Louketis, was released from jail August 25 when a judge ruled there was insufficient evidence against him. District Judge J. Robert Elliot denied a petition by Rev. Wells’ attorney, C. B. King of Albany, to remove the minister’s case to federal court. A week ago Judge ‘ Elliot ruled that Albany policemen must permit peaceful parades and protest marches here. Elliot’s ruling came at the direction of the U.S. Fifth Circuit Court of Appeals two years after civil rights leaders filed suit against city officials here. The Student Nonviolent Coordinating Committee has been conducting voter registration drives in Southwest Georgia since 1961.
