Collins and the said plaintiff having also filed in said Clerk’s office the affidavit of non-residence, showing that the residence of the defendant, upon dilgient inquiry, is unknown, and the defendant James R. Collins is not a resident of the State of Indiana, and that said cause of action is for divorce and that the defendant James R. Collins is a necessary party thereto and whereas said plaintiff having by endorsement on said complaint required said defendant to appear in said Court, and answer or demur thereto on the 20th day of April, 1960.
