Ind., April 1*.—After being out several hours a jury in the Madison circuit court was dismissed last night when it failed to agree In the case of AI Hupp, of Elwood. charged with having intoxicating liquor in his possession. Hup# was arrested in March. 1919, after police at Rlwood had seised two cases of whisky which were supposed to have been brought from Louisville to his homo. ,.vi Hupp denied at the trial that - the whisky belonged to him. The liquor was used as evidence in court, and each member of the jury smelled each of the twenty-four bottles contained In the two cases. The jurors said it was whisky, according to the odor, but it could not agree that it was the property of Hupp.
