The Harley Gibbs settlement, at West Washington street and White river, its friends believe, la doing much good in that part of the city. A Sunday-schooi Is maintained with a good attendance, and a social and religious meeting la held Wednesday of each week. The Free Kindergarten has suspended for the summer. It is hoped to establish cooking and sewing schools within the next two weeks. Arrangements have been completed by which books from the public library will be loaned for the reading room to be opened next week. Members of the committee having the settlement in charge will keep the rooms open several afternoons and evenings in the week. The rooms have been well fitted up thmugh loans and donations from merchants and friends Interested. The Btarr Plano Company has lent a very good piano; the Island Coal Company gave a ton of coal early in the season; A. A. Barnes has given a number of sewing tables, and the Sketching Club has lent a number of pictures. The Sunday-school Is supplied wlt^ papers by Secretary McMillan, of Chicago, and Bibles have been furnished by the American Bible Society through Dr. C. C. Lasby. At the present time a cook stove and kitchen safe are much needed for the cooking class to be established. The committee will send for these articles If anyone will give them. Telephone the secretary, new phone 679, or communicate with Secretary Grout, of the Charity Organisation Society. A few pictures are also much desired.

Dowling, J. (1) Section 6,766, R. S.. 18SU authorising boards of commissioners to employ persons to render additional services in case of Indispensable public necessity to be found by the board and entered of record is constitutional. (2) Such provisions of said section were not repealed by the fee and salary law of 1891. (8) Where the reasons for employing experts to search for and collect money due the county were stated In a proposition submitted by them, and the proposition was made a part of the record of proceedings of the board of commissioners, followed by a recital that It would be to the Interest of the county to accept the same, and that an Indispensable public necessity existed for the employment of experts to do work that was enumerated, the facts constituting the necessity were sufficiently found and entered of record. (4) Said Section 6,766 was within the title of the act of which It formed a part, and Is constitutional. (6) A board of commissioners has power to employ experts for such purpose aside from the provisions of said section. (6) Searching the records as experts to discover moneys due the county was not the personal duty of the commissioners. (7) One-half of the sums collected was not necessarily unreasonable compensation, where the collections were small and the labor of collecUng was great. Amount In Controvergy—Dismissal. 19,434. They, I will emphatically, to hold their respective shares of my bequest Independently of all others; he Independently of his wife and she Independently of her future husband, when she shall marry, and transmit that share to their children, if they shall have such, free from all Incumbrances and debts,” granted to the female devisee a contingent fee simple estate, subject to be reduced to a life estate upon the birth of children. (2) That construction of a will must be adopted which will give effect to the whole instrument. Setting Aside Conveyance—Devisee. 3,796. James Curtis et al. vs. Nancy E. Burns. Fulton C. C. Reversed. (1) Not only may the grantor of lands from whom & conveyance was fraudulently obtained sue to set the conveyance aside, but a person to whom he has devised his equitable title to such lands may maintain an action for that purpoce. (2) A pleading which alleged Inter alia that after the owner of certain land had devised it to the complainant, the defendant, by fraud and undue Influence. Induced such owner to convey It to her, and that the will ^remained in force at such owner’s death and was duly probated, stated a cause of action to set aside the alleged fraudulent conveyance and quiet the devisee’s title. Teacher — School Meeting — Injunc- . tion. 8,368. James P. Rumble et al. vs. Joseph D Barker, trustee. Pike C. C. Affirmed. Comstock, J. (1) A township trustee is under no legal obligation to notify the patrons of a school of hts Intention to employ a particular person as teacher. (2) The authority given to the voters of a school district by section 5988, Burns R. 8., 1894, to decide that they do not wish a certain teacher emoloyed, can be exercised by vote at a school meeting before the teacher Is hired. After the trustee has contracted with him, they can only successfully object by a majority petition for his dismissal for cause. (3) Where a trustee and a teacher, without deception or fraud, had entered into a contract before the residents of the school district took any action, a subsequent unanimous vote of a school meeting could not furnish grounds for enjoining the teacher from serving and the trustee from paying him.

Damages for Tony Shearer’s Death. On account of the death of little Tony Shearer, who was killed by a Lake Erie train, a *10,000 damage suit has been brought against the company by the boy's father, William D. Shearer. He charges that Tony and other boys were permitted by the trainmen to board a switch train, but that after it gained speed the trainmen drove the boys off by threatening to throw coal at them.
