A corflpliostJon has arisen through the failure of five county treasurers to make their December settlement* with the Auditor of State. State Superintendent Vortet says that he will not be able to make his, school, money apportionment until ihe treasurers settle. As there Is a possibility that these county officers will carry the dispute over their settlements into the courts, the school money may not bo distributed for some time. Should th* cases go to court, Superintendent Voriei says that It would be necessary to devise some means which the money coVild be apportioned. Otherwise the schools throughout the State might be seriously embarrassed. The treasurers who have refused to settle! under the fee and salary act, which Auditor Henderson claims Is still In force so fs|r as. the business of his office Is concerned, are willing to turn over their •chool money. There are no fees eonnected with these, but Mr. Henderson refuses to accept the school fund, lest it would compromise him regarding the rest ©f the settlements; over which he and the county officers have their dispute. A 'statute makes it unlawful for the Auditor to Issue warrants for money which is not In the treasury. Therefore, Superintendent Vories, although he knows precisely how much money is to tie apportioned, can not divide the money, because five counties have not made their settlements. Mr. Vorie* consulted the Attorney-General, who told hlni that It would be useless to make the apportionment. Idr. Vories was asked this morning what could be done as to the apportionment. He said that he could not tell until he had consulted Auditor Henderson. The Auditor likewise » could not tell when or how the apportionment could be made. The Auditor and the superintendent say they hope to find a way around the difficulty. The county treasurers whose failure to-hettle has caused the trouble are those In ilarlon, Vigo, St Joseph, Allen and Noble, counties. Morgan county settled to*day, and Marion county has paid In

part.

Benton county’s sheet has been received, but the treasurer. A. C. Boyce, has not yet sent the money. Superintendent Vories sent telegrams at 3 o'clock this afternoon to the treasurers of Marion, Vigo, St. Joseph, Benton, Noble and Allen counties. He informed them that until they settled he could not apportion the school funds. Auditor Henderson and his deputy, Joseph T. Fannning, say that the apportionment has nothing to do with the State treasury, the apportionment being uBmoat wholly a transaction On paper, infvofvlng the transfer of only a small sum of money.
