It is. Wwerer, one tiling to be entitled to tbe lawful and peaceable poeeession of property and another to eeek to obtain that possession by whatever method teems best to tbe person entitled to tbe possession. And right here a serious question it raised by tbe employment by the owners ot tlis works or tiieir representatives or so armed private guard to take posteesiou of the work# against the opposition of the loeked-out employes. It appears from the testimony of Mr. H. C. Frick before the congressional committee that the guard consisting ef tbree hundred so-ceiled Pinkerton men was engegsd br him before applying to the sberitt of the county for protection, aod from the testimony of the sheriff that the men composing tbe gnerd acted in a purely private eapseity, inasmuch ae be had not authorised them to be deputised. The guard was armed and uniJ ~rm*d. • • * What was the legal '^jatus^of the armed aod uniformed private It is open to grave question whether, all the circumstances of tbe ease being taken into account, the armed guard did not eonitiiute an unlawful assemblv and their acte in conflict with tbe lockea-out men a riot witbiu tbe meaning of the criminal law. An uniMrtul assembly has been defined to be an assembly ot three or more persons who with intent to carry out any common purpose assemble in such a manner or so sooduet themselves when assembled as to eause psrsons in tbe neighborhood of such assembly to fear on reasonable grounds that tbe persona ao assembled will disturb the peace tumultuously, or will by such assembly needlessly and without any reasonable occasion provoke other persons'to disturb the peace tqmultuouely; and it has been held that even a lawful assembly may become unlawful whenever the members agree to resort to violent and tumultaous measures to aceoniplfsh even a lawful end. * * Moreover, it has been held that the extreme right of defense given to a man within bis dwelling house—his castle, as the old maxim hat it—does not sxtend to hie other property. What has been said is intended to apply to the ease of the armed private guard. As regards tiie persons who engaged in conflict with them, there has never been anv question. Under the principles stated above it would seem clear that a body of private persona coming in number* and with weapons * * to regain possession of property such as that at Homestead, from persons expected to hold it by retort to violent means, is aa unlawful assembly, and their participation in a resulting conflict a riot within tbs meaning of the criminal law, whieh here has regard to the public interest and safety, and not to the purely private mtevseU involved. How tbe legal itaWa of such a body would bo regarded by the courts may be gathered from a statemen! made by Chief Justice Paxson. of the Supreme Court of Pennsylvania, in a case decided a little over two vears ago, natneiv, tho Eastoa Passongor Railway Company vs. the City of Daaton, whore, remarking upon conditions Id tho State of Pennsylvania, he

Instances are not rare and are of recent occurrence where banda of men have stood confronting each other, some of them with arms in their hands, in the assertion of •uppoeod right. The public peace haa been threatened in this manner, sometimes resulting in the loss of life. It is well that it should be known that such persons, whether representing individuals, private corporations or municipalities, are simply rioters, aod answerable to tho criminal law for their conduct.” Judging from recent occurrences the present seems to be a time when the insistence upon lawful methods, even in tho pursuit or maintenance of logal rights seoma to bo pcooliarly important. smm Xvado In tv ago*. It doubles up the cost of what workingmen buy but leaves him, as to wages, at tb* mercy of his employer, bo far ss ho ia concerned the McKinley bill is a par* question of supply and demand. If tho wooloa manufacture, protected 300 per cent, iu what his mill make*, eaa hire scab* or foreigners at half price he is at psrfect liberty to do so and tbe whole power of the government is at his back to protect him ia so doing. More than that ^tho gates of Cattle Garden swing inward.” Ho may call to his assistance in this matter of reducing wages all “the pauper labor of Earop«” to compete with his workmen and tho United Statea Government is still with
him.

Tbe children of toughs are the ones that need the best environment*. Mr. Milburn would give them the worst. They that are sick need the physician. Two things, and two things only,* will rsmovs the curse of intemperance. One is to keep tbe man from the drink, by building him up morally, mentally end physicallyteaching him tbe svii effects of alcoholics, and leading him up to better things; and the other thing to do is to keep tbe drink from tbe man, by prohibiting the manufacture, sale, importation and transportation of alcoholics in these United Htates of Ameriea, and enforcing this decree as you would any other law, in spite of the parrot cry, “It doesn’t prohibit.”
