Tbe Right of the Htate to Mvvaiup losuds huatotned by the Muprruio Court. The aupreme court to-dwy gave n decision of unusual importance, insomuch ns it sustains the right of the Mtate of Indiana lo thousands of acres of laud in the northcru part of the slate. The particular case at issue is known as the “lieuvar take cast,” and upon the decision of to-day depends the disposition of about twenty more oases that are now pending, one in the federal court, tho decision iu which, it is understood, Judge Woods has been holding oil until after the ruling of tho supreme court. In 1850 the general government, through an act of cougnjs, ceded lo the state of Indiana the title to nil tho lakes and overflowed lands in northern Indiana, and in 1853 patents were issued for th'rn. Since then, however, various eastern capitalists and others who owned luuda surrounding tiiese lakes have claimed fo own the lakes themselves, iu which the water was directly situated, ami thousand* of acre* of land fVom which the water had receded. Much of this has become quite valuable for agricultural purpose*. About K,1XX> acres were involved iu tho lieuver Luke case, aud probably U0,0(M> or "o.oou acres in all the cases. Wince Judge ilord has been attorney-general be has giveu a great deal of study and investigation to these eases, and nearly twoyaars ago, brought suit against the i’ortsmouth savings bank and twenty other defendants, in Newton county, lor possession of these lands. The decision there was in fa for -f the hunk und against the state, and this was made a ie-1 case and appealed. The decision to-duy which was giveu iu a very careful und comprehensive opinion by Judge Zollars, reverses the ruling of the lower court and instruct* it to grant the appellant* motion far a new trial and sustains the demurrer to the cross-complaint.
