In making settlement with his successor, indorsed to him a note made to said Smythe as treasurer and signed by one Brown. Smythe indorsed his name on the back of the note. It was sought to take the case out of the ordinary rules by proceeding on the theory that -mytue was liable as Indorser, and by averring that'ite had converted the money of the order and Induced his successor to accept tl.e note. These facts do not put timyihe in the relation of an original maker of the nore. Jt is the oidiexo of an indorsement by the payee In such

C. 0. Affirmed. KUiott, J.
The appellant was tried for killing one Baker, who, in "company with others, was following appellant and his compos ions in an attempt to arrest them. Pickpockets were seen iu the crowd In which deceased was; several persons had their pockets pidked, and an attempt teas made to jin k the pockets of deceased. Several wi’nesses identified apixdlant us one of the pickpocket*. It was \v»> not error for the trial court to {H-rihit the slate to prove hy several persons that their pockets were picked in the crowd in question. This evidence was proper and material. If appellant was one of those engaged in picking pocket*, the deceased and other citizens hud a right to follow and arresl him. It is not necessary that an oQeuder whom a eitizeh undertakes to arrest should be connected with the felony by direct evidence; it is sufficient if the evidence supplied by circumstances establishes this connection.
