Judge Howe has overruled the motion for a new trial in the case of David Duncan vs. the City, and the defendant has appealed to the general term. Duncan was injured by a fall in a hole on Miami street,
and the jury gave him $250 damages.

Owing to the prevulenoe of smull-pox in Ind’anola, the sabbath ichtfol entertainment advertised for Friday night has been postponed, and it is deemed best to give notice that no aervioea will be held in the church on next Sabbath as it is deemed best not to subject any of the children to unnecessary risk. A new trial has been refused in the damage suit of Eli Burdge vs. I., B. A W. railway, and an appeal has been taken to the geterul term. Burdge was a passenger ou the “rowdy train,” and owing to the smoking of other passengers, stood on the piaifotm. A suddep lurch threw him off and broke his collar-bone, for which the jury awardsd him $250. Stven fsaessmeat insurance companies have complied with the iasurance law, but tbtre are numerous concerns which are iacorporate under the “voluntary association act,” 6y filing articles with county records] a, and who have not yet complied with the btate law. After a proper time has elapsed the attorney general will take steps to stop the transactions of snch association. State Auditor Rice yesterday declined to allow any qf the $32,000 legislative appropriation for the construction of a prison sewer at Michigan City until the city council amends the ordinance more completely protecting the state’s interest. They defended on the ground that tha lease which they signed as guarantors purported to be a lease of a certain coal mine to .Times Small, Robert Riddle Matilda Small and Wm. R. Small, under the Arm name of James Small
they objected to signing the least as guarantors on the ground that it was not dgued by Riddle; that they signed as such guarantors on the nnderstandlng end condition that It he not delivered until signed by Riddle, but that the lease had beeu delivered in violation of this agree haem; that RJdiis "<* sign tb<j lease but refussd to execute the lease, was HD* * member of the firm and refused to become one. The account in yesterday’s News of the manner in which Conductor Rub tell met his death, evidently does injustice to Engineer Newton, of train No. 50, which ran into BoMMll’a caboose. Rusell’s train was making a curve at a very slow speed when Newton came ia sight of the caboose, fifteen or twenty car lengths ahead. He whittled down brakes aad reversed hie engine, but without stopping in time to avoid the accident Russell and others on his train were asleep. Newton has been railroading thirty yean, and never before eo much as mashed another’s finger.

The score of yesterday's game with the Chicagoa—24 to 5—does not tell the whole ■lory. The home club, all things considered, played creditably and gave satiafac tion. It waa remembered that all the members never saw each other before they met on the field yesterday; that not all of the regular nine were present, and that being pitted against the strongest club in the country lor a first game under such circumstances,was peculiarly trying. There were etveral individual excellences shown, and Peablea, the catcher, especially proved himself to be a firat-ciasa player ia every respect. The lesson of the Chicago club is the thoroughness wkh which they play. Their fielders do not wait to watch a ball if it ia not within reach, bnt start instantly on a “dead ran,” to be aa near the epot it strikee the ground as possible; and tbie hard playing marks every feature of the Chicago’s game. Yesterday they knocked the home pitcher all over the grounds, batting unusually strong. This, with the slow fielding and errors of the heme club, the former of which, at least, «wse to be expected from n new nine, made ’ihe score more onesided, than the actual playing merits of either nine would al low.
