W here there is no waiver of the valuation and appraisement laws of this state, cither by force of a statutory provision or under a written agreement or promise, the general law on the subject of the sale of property, on execution or ortier of •ale, is contained in section 445 of the code: wherein it is provided, that: “No property shall be sold on any execution or order of sale issued out of any court fhr less than two-thirds of the appraised cash value thereof, exclusive of liens and incumbrances, except where otherwise provided by law.” (2 R. S., 210.) In this case, the notes and the mortgage upon which judgment was taken each contained an expres, waiver of any relief from valuation and appraise n.ent laws of this state, and judgment .-mould lave been rendered to be executed without re lief from valuation or appraisememt laws. (2 R. S., 188; Acts 1858, p. 30; 2 R. S., 138; Acts 1801. 145c 1 R. 8., 036.) Therefore any work placed in charge of the commissioners of a county, is in charge of the county, ami thereby becomes a county work for-the performance of which the commissioners are required to lake a bond.
