The supreme court this moming rendered! its decision in the case of William E. Merrick, Judge Biddle delivering the opinion. The lower court is sustained and he will be hanged to-morrow. There is now nothing but executive clemency that can save him. The action of the supreme court in this case gives great satisfaction, as there was for a time a wide-spread fear that on some technicality he, as well as Guetig, might be given a new trial with a chance to escape the penalty of his cold-blooded and inbnman murder. The opinion of the court

is as follows:

The appellant was indicted tor the murder ol Julia Merrick, tried, convicted and sentenced to deatb. The indictment contains two counts, each eount charging murder In the first degree. The tint eount charged the killing to have been don* by administering poison; the second, by indicting certain mortal wounds. On motion tor a new trial ’ seventy-two causes were assigned therefor, but as toe evidence, to whleh the instructions given and refused had rwferepcf, and upon which the conviction was had, fs not before us, but few questions are raised thereby. Such questions as are properly presented by the record, and dlscUaeed on behalf of the appellant, wLl be noticed la the order of the proceedings. (1.) Instead of that, ho we ver,he bore it with remarkably equanimity, merely remarking, “Is that so? I am sorry.” He then passed into the private room with the reverend gentleman with whom he is again closeted this afternoon. He shows no sign of breaking up, and a confession is not looked for, unless at the very last moments. A Novel Defense. The case against Hamilton Bailie, for selling a short-weight load of coal, was submitted to Mayor €aven yesterday on an agreed statement of facts. The defense was that congress, which alone had the power, had never established a standard bushel for this country; that such being the caw the common haw of England governs; that the bushel there contains 2,150 42-100 cable iar cbes; that that bushel has been accepted by the state; that the bushel adopted by the council, containing 2,680 inches, is not sustained by law, and measures by that standard can not be entcroed. Mayor Caven took the quenon under advisement to decide whether the council has power to regulate the stand*: ard of measurement If he decides to the affiemative, a fine will be assessed and Mr. Bailie will appeal to the higher courts.
