Walkerton Town Council Minutes MEETING CALLED TO ORDER: The Walkerton Town Council met on November 4, 1996 with 14 people present. ROLL CALL: The roll call was taken and the following council members were present: Randy Hoover, Walter Heil, Gregory Williams and Gordon Hartsell. Council member Gene Reese was absent. Also present were Kathryn Chrapliwy, clerktreasurer, and Fred Jones, town attorney. MINUTES: The minutes of the meeting on the 28th of October were approved by general consent. DEPARTMENT HEAD REPORTS: FIRE DEPARTMENT: Carl Sobieralski delivered a written report from Fire Chief Larry Dill for the month of October. Report was accepted. POLICE DEPARTMENT: Police Chief Carl Sobieralski presented a written report for the month of October for the Police Department. Report was accepted. FIRE STATION ADDITION FINANCES: The financial figures for the proposed addition to the fire station were not received from First Source Bank for tonight’s meeting, therefore this item was tabled. FACT FINDING: No information was received from Kenny Bolze at this time. COVENANTS/GLEN N VIEW ESTATES: This information was to be presented by council member Gene Reese. Mr. Reese was
absent. MILLERS MERRY MANOR: Attorney Fred Jones reported that MMM-Invest, Inc. has now executed a Grant of Non-exclusive Easement. Additional provisions with regard to the grant of the easement will be required. It will be necessary for the Walkerton Town Council to appoint someone to represent the council and to inform a representative of MMMInvest, Inc. to work with the contractor in relocating the 16 small pine trees that are involved in the project. President Greg Williams appointed Gene Reese to be the council’s representative. CREECH PROPERTY: The necessary survey concerning the three lots in Walkerton owned by Oma Creech, which the Town of Walkerton is attempting to obtain by eminent domain proceedings, has been obtained. The survey was done by Plymouth Land Survey. The survey has now been put into the hands of Mr. Charles Lienhart, । of Charles Lienhart Associates in Plymouth. The survey of the property is a necessary step to take in order for State approval for an appraisal. ESTIMATE ON WINDOWS: An estimate on replacement of the windows in the Town j Hall and Clerk’s Office was received from Harmon Glass. The clerk was asked to get another estimate for comparison purposes. ANNEXATION ORDINANCE/2ND READING: Attorney Jones read “An Ordinance Annexing Certain Contiguous Lands To The Town of Walkerton, St. Joseph County, Indiana” in full. Council member Heil made a motion to accept
the Annexation Ordinance on second reading. Council member Hoover seconded that motion and the motion passed with a 4-0 vote in favor. DAVID BEHR/LIBRARY BIDS: David Behr announced that the bid opening for the Library was today at 3:00 pm. There was not a full complement of Library Board Members to make a decision on the bids and therefore, the bids will be decided at a later date. David Behr also announced that the Department of Commerce has denied the Randy Williams Project. As soon as more information is available he will let the council know what the reasons were for the rejected application. WEST YORK COMMITTEE: Council member Hoover has announced that he has picked his Committee for the Betterment of West York. They are: Jon Pairitz, Carl Sobieralski, Greg Williams, David Behr and Pamela Adkins. RANDY WILLIAMS: Randy Williams informed the council that he had two major concerns on the latest sewer project that went in on the south part of town. One was the stub of the road known as Williams Street. The street, curb and pavement were not replaced after Oselka finished the project. Accordingly, to extend the apron 10 feet south using a unite price for road restoration and assuming sl2 per linear foot for curb and gutter, this would equate to a back charge of $655.00. Mr. Williams said that he would be satisfied with that he just did not want this to slip through the cracks and be forgotten. Another issue was the drain line to the retention basin on the west side of Palm Circle
that was destroyed by Oselka during construction. This area has flooded out with the last two rainstorms and will only get worse. The council decided that they would have a video taken of the pipe and then have it repaired. HOMEOWNERS ASSOCIATION OF HICKORY LANES SUBDIVISION: Faye Snodgrass and Terry Roush were present representing the Homeowners Association of Hickory Lanes Subdivision. They informed the council that they have met and reformulated the homeowners in that community. They are developing a set of covenants that they intend to record and to present to the Town for their records. They also asked that some additional street lights be put in their subdivision. Since all of the electric needs to be put underground in that subdivision some research will be made on the feasibility of putting in more street lights. IACT: Indiana Association of Cities and Towns are requesting a voluntary special assessment based upon population to cover the costs of hiring a contract lobbyist. The lobbyist will represent all of the towns on the T elecommunications Act of 1996 because Congress opened the door to regulatory battles on the state and local levels. Council member Hoover made a motion to accept the assessment based on .03 per capita. Council member Hartsell seconded the motion and the motion passed with a 4-0 vote in favor. HEALTH INSURANCE FOR THE TOWN: The new health insurance policy for the town employees showed a 2 percent increase over last year but with added benefits. The policy was accepted on a motion by council
member Heil and seconded by council member Hoover. Passed with a 4-0 vote. CITIZENS INPUT: T^nyßoush expressed his concern over tar that was spread along Palm Circle due to some tar buckets left at the site of construction that Randy Williams was doing in that area during a recent flooding. The attorney said that the matter would be a civil matter between two homeowners. David Behr said that he was speaking for a teller at First Source Bank who was questioning why there was not a 4-way stop at the Van Buren and Illinois Street Intersection. Greg Williams said that he would have a traffic study done of that intersection to see if it would need a 4-way stop. CLAIMS: Claims # 1164 to 1219 totaling $121,645.34 Payroll Claim totaling $21,735.05 Council member Heil questioned two claims for Richard Flaugher. Council member Heil made a motion to accept Claim Docket totaling $121,645.34 and Payroll Claim Docket totaling $21,735.05. Council member Hoover seconded the motion and the Claim Dockets were passed with a 4-0 vote. ADJOURNMENT: With no further business to come before the council the meeting adjourned on a motion by council member Hartsell and seconded by council member Heil.
