The check was deposited into the Town Court’s bank account. Council member Reese made a motion to request that money for the General Fund. A second motion was made by Hoover. The vote was 5-0 in favor. The Council asked that the clerktreasurer talk to the present judge about the motion that was passed. STATUS OF CREECH PROPERTY A resolution (1996-3) was passed concerning the properties located at 601, 603, 605 Jackson Street belonging to Oma Sue Creech. The Town would like to acquire these properties by eminent domain for the purpose of constructing a new ambulance facility. The Town needs to obtain an appraisal of the properties. to call Ed Walz in order to get an appraisal. The resolution was passed with a 5-0 vote on a motion by Reese and a second by Hoover. STATUS OF MILLER’S & JOHNSON SEWER EXTENSION The attorney informed the Council that he had just finished dictating a letter to Miller’s Merry Manor regarding the sewer extension and that he would update them before the next meeting. STATUS OF FOCUS FUND GRANT David Behr was present to inform the Council about the Community Focus Grant. Randy Williams subdivision is the next candidate for the Focus Grant. A hearing is scheduled for Sept. 16th meeting to finalize the application. The Grant is for $360,000. Randy Williams will be pledging 90,000 for this project. Resolution 1996-2 was approved for this project. A motion was made by reese and seconded by Hoover to approve the resolution. The vote was 41 with Williams voting against the project. NEW FIRE TRUCK
FINANCES The quotes that were submitted from Ist Source Bank did not appear to be accurate so the Council asked the clerk to check them out with the bank officials to see if an error had been made. The Council also asked the clerk to invest the $300,000 in a seven day note. NEW BUSINESS HIRING OF NEW EMPLOYEE Supt. Jeff Zehner informed the Council that he had intervierwed a number of people last week to fill the open position on the Wastewater/Street Depar-

Council member Reese made a motion to hire David Searfoss, seconded by Heil and the motion passed with a 5-0 vote. MAHONEY LICENSE BRANCH CONFLICT Mr. Mahoney allegedly had the signs removed from the License Branch that was helping to deter the traffic problem in that area. the attorney. The attorney was instructed to inform Mr. Mahoney that he needed to respond by the next Council meeting. If he failed to do so there would be some options that the Town would consider, that being: close the alley, tow vehicles which are improperly parked on the alley and requesting damages for the unauthorized civil trespass on the alley during the paving operation. This was put into a motion that was made by Reese and seconded by Heil. The vote was 5-0 in favor. (Continued on Page 11)
