Walkerton Town Council Minutes CALL TO ORDER The meeting of the Walkerton Town Council was called to order at 7:00 p.m. on Monday, August 5, with 13 people present. ROLL CALL Roll call was taken and the following Council members were present: Gene Reese, Gordon Hartsell, Randy Hoover, Walt Heil and Greg Williams. Town attorney, Fred Jones and clerk-treasurer, Kathryn Chrapliwy were also present. MINUTES The minutes of the July 15th Council meeting were approved by general consent. DEPARTMENT HEAD REPORTS POLICE DEPT. C. SOBIERALSKI Town Marshal, Carl . Sobieralski presented the Council with a written report on the activities of the Police Department for the month of July as follows: 113 traffic infractions; 299 incident reports; 2 accidents; 7 house watches; 6 impounds; 48 criminal investigations; 46 arrests and 3 alarms. Reese complimented the Marshal on the fine job the officers were doing in patrolling the town and eliminating speeding throughout the town. Hoover asked how the Marshal was monitoring the officers with regard to always wearing a uniform while on duty. The Marshal said that he had en-

countered a problem recently but that he had taken care of the matter. Sobieralski informed the Council that the department was awarded a grant for $22,000. The grant is four four new radar units at $2,050 each and 832 man hours. BUILDING INSPECTOR CARL SOBIERALSKI A report on the building permits for the month of July was presented by Sobieralski. There were six roofing permits, two additions and one new construction during the month of July totaling $480.00. FIRE DEPARTMENT LARRY DILL, CHIEF Fire Chief Larry Dill presented the monthly Fire Dept, report for July as follows: 3 grass fires; 5 other fires; 2 10-50’s; 2 false alarms; 2 mutual aid fires; 3 mutual aid rescues and 1 mutual aid/other. Dill also reported that they will be picking up the new fire truck on August 13 and delivering it to Valparaiso. It will be ready for use around the first or second week in September. Dill asked the attorney if he would need to look at the specs for the new fire station addition before they went out for bids. The attorney said that he would like to see the specifications and prints before they are advertised. OLD BUSINESS TRIAX CONTRACT The contract between Walkerton and Triax Cablevision was passed on the third reading. The motion to approve was made by Heil and the second to the motion was made by Hoover. The vote was 5-0 in favor. SEWER PROJECT
The clerk-treasurer informed the Council that Walkerton had agreed to contract with Woodruff & Sons, Inc. for the work that needed to be done on the North Sewer Project. The contract was for a sum of $395,770.16. The total amount of payments made to Wopdruff were $392,465.97 leaving an unpaid balance of $3,304.19. Jeff Zehner said that the work had been completed and that there was a Performance Bond in place. The attorney announced that the claim from the Dairy Queen had been rejected by the insurance company who represents the Town. Reese made a motion to pay Woodruff the remaining $3,304.19; seconded by Hartsell and the motion passed with a 50 vote. PAST TOWN COURT JUDGE The attorney was asked to examine the records that were on file to determine if any restitution had been made by the former Judge, Judy Baker. The attorney informed the Council that he was unable to obtain any of the records from the bonding company because they said that he was not privy to that information. The clerk-treasurer was asked to get in touch with Ed Walz on the bonding information. CREECH PROPERTY A letter was sent to Mr. Creech about the condition of his property on Jackson Street. The time allotted for Mr. Creech to clean up the area in question has expired and Jeff Zehber was asked to take pictures of the area and then clean it up. The council then informed the attorney that they would like to initiate

CSX PROPERTY The attorney advised the Council that he had contacted the law firm of Barnes & Thornburg for an attorney who specializes in environmental issues. Mr. Lawrence McHugh has agreed to handle the issue with CSX property and said that the blended rate would be $l5O an hour. Hoover made a motion to obtain the services of Mr. McHugh, seconded by Reese and the motion passed with a 5-0 vote. MILLER’S MERRY MANOR/JOHNSON SEWER LINE The attorney asked Zehner to take pictures of the trees that had been talked about in recent months that apparently stand in the way of the new sewer extension to Grover and Paula Johnson’s property. A layout of the trees will also have to be done before work can begin. NEW BUSINESS AMBULANCE CONTRACT WITH COMMUNITY EMS The contract between Community EMS and Walkerton will be canceled as of October 1, 1996. Reese made a motion to send a notice of cancellation to Community EMS, seconded by Hartsell, and the motion passed with a 5-0 vote. BUILDING INSPECTOR Seven applications were

The Council decided to meet in an administrative meeting at 6:30 p.m. before the next regular Council meeting on the 19th of August to discuss the applicants. COLBY NILES COMPLAINT ON SEWER Mrs. Joan Niles delivered a letter to the Council about her concerns regarding her sewer line. Mrs. Niles was present to talk to the Council. Zehner informed the Council of where the sewer lines were in that area. A discussion was held and the outcome of the discussion was that Mrs. Niles would have to decide by the next Council meeting if she and her husband would agree to pay the cost of installing a new line to the front edge of her property then the town could connect the newer sewer line across the street from the Niles residence. CLAIMS Payroll claims for July 15: $22,736.77; July 30, 1996: $22,534.04 and August 5, 1996: $1,050.00 as well as claim docket August 5, 1996: $125,746.93 were approved on a motion by Reese and seconded by Heil. CITIZEN INPUT Mr. Dan Barden, project manager of the magnesium processing plant known as Rossborough, was present to inform the Council that since March 26th of this year Rossborough Manufacturing has experienced power failures that amount to a loss of 16.5 working (Continued on Page 11)
