ORDINANCE NO. 1996-05 AN ORDINANCE TO AMEND TITLE 5, ARTICLE 3, CHAPTER 1 OF THE NORTH LIBERTY TOWN CODE RELATING TO SEWER RATES AND CHARGES BY ADDING A NEW SECTION 2 WHEREAS, the Town Council of the Town of North Liberty has determined that a need exists to establish uniform and revised non-recurring charges for the Sewer Utility. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of North Liberty, Indiana: SECTION A. Title 5, Article 3, Chapter 1, Section 1 of the North Liberty Town Code is hereby amended by adding a new Section 2 reading as follows: SECTION 2 Non-recurring Charges. Description of Charge Charge Connections (tap-ins) Labor and materials of not less than $65.00 or SI.OO per lineal foot of property abutting the sewer line Bank Check Charge $20.00 plus any bank charges Late Payment Charge 10% of charge Service Call $30.00 per hour per man plus materials during business hours; $50.00 per hour per man plus materials during non-business hours. Backhoe shall be charged at $75.00 per hour. Minimum Payment Still due and payable whenever service has been temporarily disconnected for benefit of the customer. Single Service Stop When more than one (1) meter is served by a Multiple Meters single service stop, the owner of such property shall be responsible for any delinquencies because of non-payment of a tenant. Rental Property All final billings to tenants not paid within thirty (30) days will be billed to the landlord. If not paid within a reasonable time, amounts past due will be filed with the County for collection with the property taxes as allowed by law. SECTION B. All ordinances and parts of ordinances in conflict therewith are hereby repealed; provided, however, that the exisiting schedule of non-recurring sewage rates and charges shall remain in full force and effect until the schedule of rates and charges fixed by this Ordinance shall be approved by the Town Council of the Town of North Liberty, Indiana, and until the order of said Town Council approving said new rates and charges shall direct. SECTION C. Server ability. If any Section or part of this Ordinance or Code be for any reason held unconstitutional or invalid by a court of competent jurisdiction, that holding shall not affect the validity of the remaining portions of the Ordinance or Code, but the remaining portions shall be and remain in full force and effect. SECTION D. Effective Date. This Ordinance shall be in full force and effect from and after its adoption by the Town Council, its legal publication as required by law, and its filing in the Office of the Clerk/Treasurer.
