the Town of Walkerton, St. Joseph County, Indiana, at their regularly scheduled meeting of December 18, 1995, enacted and adopted a new Walkerton Town Code by Ordinance No. 1995-16, which Town Code

shall be effective immediately upon publication as provided by law. Copies of the Town Code are available for public inspection and review at the Clerk’s office in the Walkerton Town Hall. Due to the length and extent of the Town Code, the Ordiance adopted the same by reference, it being economically and physically impossible to publish the entire Town Code. The Ordiance reads as follows: ORDINANCE NO. 1995-16 ORDINANCE ADOPTING THE WALKERTON TOWN CODE WHEREAS, the present general ordinances of the Town of Walkerton are incomplete and inadequate and the manner of arrangement, classification and indexing thereof is insufficient to meet the immediate needs of the Town; and WHEREAS, the acts of the General Assembly of the State of Indiana empower and authorize the Town Council of every town to revise, amend, restate, codify and to compile any exisiting ordiance or ordinances and all new ordinances not heretofore adopted or published and to incorporate said ordinances into one ordinance in book form; and WHEREAS, the Town Council of the Town of Walkerton has authorized a general compilation, revision and codification of the ordiances of the Town of a general and a permanent nature and publication of such ordinances in book form. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Walkerton, Indiana that: Section 1. The General Ordinances of the Town of Walkerton, Indiana, are herein revised, amended, restated, codified and compiled into book form, or adopted as and shall constitute the “Code of Ordinances of the Town of Walkerton, Indiana.” Section 2. All prior ordinances pertaining to the subjects .treated in said Code shall be deemed repealed from and after the effective date of said Code, except asHhey are included and reordained in whole or in part in said Code, provided such repeal shall not affect any offense committed or penalty incurred or any right reestablished prior to the effective date of said Code or shall such repeal affect the provisions of ordinances levying taxes and appropriating money, annexing or detaching territory, establishing franchises or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money,

authorizing the purchase or sale of real or personal property, granting or accepting easements, plats or dedication of land to public use, naming or vacating or setting the boundaries of streets, alleys, or other public places or to other ordinance of a temporary or special nature pertaining to subjects not contained therein. Further, all ordinances establishing rates and charges for utilities shall not be modified or repealed except as specifically provided herein. Section 3. Said Code shall be deemed published as of the date of its adoption and approved by the Town Council and the Clerk-Treasurer of the Town of Walkerton is hereby authorized and ordered to file a copy of said Code in the office of the Clerk-Treasurer. Section 4. Said Code shall be in full force and effect two (2) weeks from the date of its publication and filing thereof in the office of the Clerk-Treasurer; said Code shall be presumptive at all courts and all places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage; the same is properly signed, attested, recorded and approved; that any public hearings and notices thereof as required by law have been given. PASSED by the Town Council of the Town of Walkerton, St. Joseph County, State of Indiana, this 18th day of December, 1995.
